ADMINISTRATIVE ORDER NO. 52-13-01-F <br />of the <br />City Manager of the City of Eugene <br />ADOPTION OF AMENDMENT TO ADMINISTRATIVE RULE R -3.696 <br />TO ADD REPORTABLE CHEMICALS PURSUANT TO SECTION 54 OF <br />THE EUGENE CHARTER, 2002. <br />The City Manager of the City of Eugene finds that: <br />A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt <br />rules for the administration and implementation of any provisions of that Code. Section 3.696 of <br />that Code specifically authorizes the City Manager, after obtaining advice from the Toxics <br />Board, to adopt an administrative rule adding chemicals to the list of substances required to be <br />reported under Section 54 (Amendment IV) of the Eugene Charter of 2002 ( "the Amendment "), <br />establishing reporting and materials balancing thresholds for those chemicals, and establishing a <br />date when the additional chemicals shall be subject to the reporting and materials accounting <br />requirements. <br />B. On December 20, 2000, the City Manager issued Administrative Order 52-00-04 - <br />F adopting Hazardous Substances Reporting Requirements Administrative Rule R- 3.696. That <br />Rule added chemicals to the list of substances required to be reported under the Amendment, <br />established reporting thresholds and material accounting thresholds for each chemical added, and <br />changed previously established reporting thresholds and material accounting thresholds for <br />certain chemicals already subject to the reporting requirements. <br />C. The Toxics Board has recommended that chemicals be added to the list of <br />reportable chemicals. Therefore, on September 19, 2013, I issued Administrative Order No. 52- <br />13-01 proposing to amend Administrative Rule R -3.696 to add characteristic chemicals that have <br />been previously reported by reporting businesses and to add chemicals which were previously <br />removed in error. <br />D. Notice of the proposed amendment was given by making copies of the Notice <br />attached as Exhibit B to Administrative Order 52 -13 -01 available to the Mayor and City <br />Councilors, to any person who had requested such notice, and by publication of the Notice in the <br />Register Guard Newspaper on September 30, October 1, 2, 3, and 4, 2013. The Notice provided <br />that comments or objections be submitted within 15 days of the first date of publication of the <br />Notice. No comments were received within the time or in the manner described in the Notice. <br />Based on the above findings, and the authority of Sections 2.019 and 3.696 of the <br />Eugene Code, 1971, Administrative Rule R- 3.696, which was adopted by Administrative Order <br />Administrative Order - Page 1 of 2 <br />
