(6) <br /> <br />Section 4. <br /> <br />If authorized under the City Manager's rules for priority of placement, <br />containers supplied by licensed solid waste and recycling firms may be <br />placed: <br />(a) On a sidewalk, provided the placement of the container(s) leaves <br /> at least three feet of the paved area of a sidewalk unobstructed; or <br />(b) Between the curbs of streets that do not have designated bicycle <br /> lanes immediately adjacent to the curb, <br />no earlier than 7:00 p.m. on the day prior to the customer's regularly <br />scheduled collection service, and shall be removed no later than <br />midnight of the day of the collection service, or in such other manner or <br />place as authorized by administrative rules adopted by the City <br />Manager pursuant to section 2.019 of this code. <br /> <br />Section 6.050 of the Eugene Code, 1971, is amended to provide: <br /> <br />6.050 <br /> <br />Garbage and Debris - Disposition. An owner or person in charge of <br />property shall dispose of perishable garbage before it becomes offensive <br />promptly, but in any event at least bi-weekly; and not permit garbage to <br />accumulate on or about the premises. All garbage shall be disposed of in a <br />manner which does not create a nuisance and which is permitted by this <br />chapter. Garbage may be disposed of by hauling or causing it to be hauled <br />to the appropriate solid waste disposal site permitted by the Oregon <br />Department of Environmental Quality to receive such waste. <br /> <br />Section 5. Subsections (3) and (4) of Section 6.055 of the Eugene Code, 1971, <br /> <br />are repealed. <br /> <br />Section 6. The City Recorder, at the request of, or with the concurrence of the <br /> <br />City Attorney, is authorized to administratively correct any reference errors contained <br /> <br />herein or in other provisions of the Eugene Code, 1971, to the provisions added, <br /> <br />amended, or repealed herein. <br /> <br />Passed by the City Council this <br /> <br />12th day of April 2004 <br /> <br /> City Recorder <br /> <br />Approved by the Mayor this <br />t~'~~ day of April, 2004 <br /> <br /> M~y~r 7 <br /> <br />Ordinance - 2 <br /> <br /> <br />
