7.785 Char,qes - Penalty for Nonpayment. <br /> (1) In the event a person responsible becomes delinquent in the <br />payment of TSM fees, there shall be added to the charges a penalty in the amount of 10 <br />percent of the delinquency and the total amount due shall bear interest at the rate <br />established in section 2.022 of this code from the date of the delinquency. <br /> (2) In the event any suit or action is instituted to enforce this section, if <br />the city is the prevailing party, the city shall be entitled to recover from the person sued <br />reasonable attorney's fees at trial or upon appeal of such suit or action, in addition to all <br />other sums provided by law. <br /> <br />7.790 Charges - Cost of Collection. The person or entity collecting the TSM fees <br /> may withhold from payments received a reasonable charge for actual <br />costs of billing, collecting and remitting the fees. The charge shall be established <br />annually by agreement between the city manager and the person or entity and shall be <br />based on actual costs. <br /> <br />7.795 Administrative Requlations and Methodoloqy. The city manager may <br /> adopt and amend such rules and methodologies as are necessary for the <br />administration of the duties required by sections 7.750 through 7.790 of this code, as <br />provided in section 2.019 of this code. <br /> <br /> Section 2. The City Recorder, at the request of, or with the concurrence of the <br /> <br />City Attorney, is authorized to administratively correct any reference errors contained <br /> <br />herein or in other provisions of the Eugene Code, 1971, to the provisions added, <br /> <br />amended or repealed herein. <br /> <br /> Section 3.
