RECEIVED <br /> <br /> SEP 2. 8 2004 <br /> <br /> CITY OF EUGENE <br />September 28, 2004 PLANNING DEPARTMENT <br /> <br />Eugene Planning Commission <br />City of Eugene Planning Division <br />99 West l0th Avenue <br />Eugene, OR 97401 <br /> <br />Re: RA 04-1 and Z 04-4 <br /> <br />Dear Planning Commissioners: <br /> <br />As requested by members of the Planning Commission, a neighborhood <br />representative met with representatives of the applicant to discuss ways in <br />which RA 04-01 might be amended so that it would comply with the adopted <br />policies in the neighborhood refinement plan governing Land Use and Future <br />Urban Design in the East Laurel Hill area (Laurel Hill Plan, pp. 13-16). <br /> <br />In his letter to the Planning Commission dated September 21, 2004, Mr. Terrell <br />correctly identifies the two issues discussed: 1) no net increase in the acreage <br />in the East Laurel Hill node designated for commercial purposes, and 2) a 90 ft. <br />non-commercial buffer along the west edge of the parcels under consideration. <br /> <br /> Mr. Terrell then goes on to say "the applicant cannot accommodate the Laurel <br /> Hill Citizens neighborhood group's desire for a commercial land swap". <br /> <br /> While this is certainly regrettable, the request is much more that a desire by a <br /> group of neighbors. It is a requirement of an adopted refinement plan, and as <br /> such is not optional. Nor is it just the neighborhood group that should defend <br /> the integrity of the Laurel Hill Plan and the Metro Plan. It is equally incumbent <br /> on City staff and members of the Planning Commission to do so. <br /> <br /> EC 9.8424(1)(c) and LHP Policy 5 <br /> <br /> (1) The refinement plan amendment is consistent with all of the following: <br /> <br /> *oo <br /> <br /> (c) Remaining portions of the refinement plan. <br /> <br /> Policy 5. No additional sector of East Laurel Hill shall be designated for <br /> commercial purposes until a public need can be demonstrated. <br /> (Laurel Hill Plan, p 15) <br /> <br /> IV-79 <br /> <br /> <br />
