Page 5, letter from LHVC re: RA 40-1 and Z 04-4 dated September 28, 2004

position that, in adopting the new Metro Plan Diagram, it was not changing any
plan designation for any parcel." Since the parcels of the application are
clearly outside the commercial node in the Laurel Hill Plan, their designation
before and after the adoption of the new Metro Plan Diagram is residential.
Any map labeling them differently is clearly a simple cartographer's error and
must be corrected.

In conclusion, we regret that the applicant was unwilling to modify the plan
amendment application to comply with the remaining provisions of the Laurel
Hill Plan. As it stands, neither of the two criteria set out in EC 9.8424 has
been met, therefore RA 04-1 should be denied.

Sincerely,

Rich Hazel dan Wostmann
Co-Chair, LHVC Vice-Chair, LHVC

IV-83
