August 5, 2004 <br /> <br />Patricia Thomas <br />City of Eugene Planning Division <br />99 West l0th Avenue <br />Eugene, OR 97401 <br /> <br />RE: RA 04-1 RECEIVED <br />Dear Ms. Thomas: <br /> <br />The Laurel Hill Valley Citizens neighborhood association ask that RA 04-1, <br />A REFINEMENT PLAN AMENDMENT TO THE LAUREL HILL PLAN, be <br />rejected because it meets neither of the two criteria for approval of <br />Refinement Plan Amendments contained in EC 9.8424. <br /> <br />(1) The refinement plan amendment is consistent with all of the <br /> following: <br /> <br /> lc) Remaining portions of the refinement plan. <br /> <br />The request is not consistent with the remaining portions of the Laurel Hill <br />Plan. The applicant is correct in stating that the East Laurel Hill section <br />(adopted in 1982) of the Laurel Hill Plan applies to the subject property. In <br />particular <br /> <br /> Policy 5. No additional sector of East Laurel Hill shall be designated for <br /> commercial purposes until a public need can be demonstrated. <br /> (Laurel Hill Plan, p 15) <br /> <br />This policy directly contradicts the applicants' desire to designated the <br />subject property for commercial development. The dear and plain intent of <br />this policy is to preclude designating additional acreage for commercial <br />purposes until the acreage set aside for such purposes in the commercial <br />node has been developed and then an additional unmet public need for <br />commercial property in East Laurel Hill is identified which outweighs the <br />need for other uses. Since no commercial development of any kind has yet <br />occurred on the land within the commercial node (including on land owned <br />by the applicant that is within the node), it is preposterous to suggest that <br />a public need for additional commercial land already exist. <br /> <br />(2) The refinement plan amendment addresses one or more of the <br /> following: <br /> <br /> {c) New or amended community policy. <br /> <br /> I-A-3 <br /> <br /> <br />
