Refinement Plan Amendment - TRS 18-03-03-2-3, Tax Lots 199, 200, 300 <br /> January 13, 2004 <br /> Page 11 <br /> <br /> Findings: The purpose of Goal 14 is to provide for an orderly and efficient transition <br /> from rural to urban uses. The focus of the rule is upon expansion of the urban growth boundary <br /> (UGB). The subject property is not in rural use and is within the City of Eugene's UGB. <br /> Approval of the application will promote the expansion of urban uses within the UGB. <br /> <br /> COnclusion: The proposal complies with Goal 14. <br /> <br /> Goal 15: Willamette River Greenway: To protect, conserve, enhance and <br /> maintain the natural, scenic, historical, agricultural, economic and <br /> recreational qualities of lands along the Willamette river as the Willamette <br /> River Greenway. <br /> <br /> Findings: The subject property is not located within the Willamette River Greenway and <br /> will not impact the willamette River Greenway. <br /> <br /> Conclusion: This Goal is not relevant to the proposed amendment. <br /> <br /> Goals 16 through 19: <br /> <br /> Findings and Conclusion: Goals 16 through 19 are not relevant to the proposed <br />amendment because the subject property is not located in the geographic regions the Goals <br />address. These Goals include: Goal 16: Estuarine Resources; Goal 17: Coastal Shorelands; Goal <br />18: Beaches and Dunes; and Goal 19: Ocean Resources. <br /> <br /> Conclusion: The proposal is consistent with the statewide planning goals. <br /> <br />B. "(1) The refinement plan amendment is consistent with all of the <br /> following: <br /> <br /> "(b) Applicable provisions of the Metro Plan."~ <br /> <br /> (Goal) Use urban, urbanizable, and rural lands efficiently and in the public interest. <br /> (II-A-I). See also Goal #1 at II-B-2. <br /> <br /> ~ Applicants belieVe that the proposal is consistent with the Metro Plan and with all of the <br />applicable refinement plans. This application has been liberal in addressing potentially applicable <br />policies and objectives. This is despite the fact that the Eugene Hearings Official has held that plan <br />policies that are described as "recommendations" or that contain language such as "recognize" or <br />"encourage" do not constitute mandatory approval criteria for rezone applications. See Exhibit F, <br />Hearings Official's Decision for Merritt-Truax, Inc. Zone Change (Z 02-19). Consequently, some of the <br />policies addressed may not be applicable. Applicant makes no attempt to distinguish between provisions <br />that are mandatory and those that are not in these application materials, although the Applicant reserves <br />the right to make such distinctions in the future. <br /> <br /> <br />
