EXHIBIT D

Dan Terrell

From: Thomas. B.BOYATT@odot.state.or.us
Sent: Tuesday, September 14, 2004 1:35 PM
To: danterrell@landuseoregon.com; Gary. A.MCNEEL@ci.eugene.or.us;
patricia.thomas@ci.eugene.or.us
Cc: Thomas. B.BOYATT@odot.state.or.us
Subject: RE: ODOT Comments for RA 04-1 and Z 04-4, Eugene Land Use Applications

Dan - on p. 5 of the May 7, 2004 TIA Addendum, under a description of the
2019 no build condition, the first sentence states that all Cooperative Improvement
Agreement mitigation is assumed to be in place by 2019 and therefore there is no problem.
This includes the signal in question. Also reference the conclusions section on p. 8.

My original comments stand as 1) There is no evidence as to when (the year) the signal
will be installed, and 2) there is no evidence that the proposal will not degrade the v/c
between PAPA approval and whenever the signal is installed. Under Jaqua, you should
really show when the signal is needed and demonstrate in evidence that it will be
installed when needed. The city could help you with this by committing to install the
signal when v/c is triggered.

Also, as an aside, applicant's development traffic still goes through that intersection
whether via Moon Mtn or Brackenfern.

Gary - if I am OTL on any of this please let me know. My read is that it is a simple
matter of the City committing to the signal when needed for state highway mobility. (Note
that this is different than relying on the CIA - which is related to the public approach
permit for Brackenfern and does not anticipate this zone change, nor the particular years
of development phasing or mitigation in the CIA.)

Patricia - Please distribute my response to Dan's email to the PC tonight.
I would ask you to distribute Dan's email as well, but it may be privileged
- so you would have to ask him. Thanks, T

..... Original Message .....
From: Dan Terrell [mailto:danterrell@landuseoregon.com]
Sent: Tuesday, September 14, 2004 12:17 PM
To: BOYATT Thomas B
Cc: Dan Terrell
Subject: ODOT Comments for RA 04-1 and Z 04-4, Eugene Land Use Applications

Tom

I am writing concerning your September 2, 2004, e-mail comments to Gary
McNeel and Patricia Thomas concerning the applicant's traffic analysis for
RA 04-1 and Z 04-4. I represent the applicant.

We submitted two different traffic studies in support of the application: a
Traffic Impact Study dated December 1, 2003 and a Traffic Impact Study
Addendum dated May 7, 2004. I was wondering if you received a copy of the
Addendum because your comments appear to address issues concerning the
I-5/Moon Mtn./Glenwood Blvd. intersection, which was an issue with the first
traffic study. It was my understanding that the addendum, which reflected
the closure of east bound traffic on Moon Mtn. whereas the original study
did not, did not indicate any failure (temporary or otherwise) to the
I-5/Moon Mtn./Glenwoood Blvd intersection.

If you have not received a copy of the Traffic Impact Study Addendum, please
let me know and I will forward a copy of it to you. If your comments are
based on a review of both studies, please let me know. I would like to talk
with you to find out exactly what we need to do to demonstrate that there
will be no temporary failure of traffic facilities or that failures will be IV-27
