Eugene Planning Commission <br />September 21, 2004 <br />Page 6 of 7 <br /> <br /> Traffic Issues <br /> <br /> The Planning Commission expressed some interest in the overlap of jurisdiction over <br /> transportation issues relating to these applications. Pertinent here are addressing ODOTs Goal <br /> 12 related concern, which is the timing of the installation of the signal at the Moon Mountain <br /> Drive-Glenwood Boulevard-Glenwood Drive intersection, and the availability of City traffic <br /> facilities to serve uses allowed if the applications are approved. ODOT's concerns relate to the <br /> Plan Amendment and the City issue pertains to the zone change application. <br /> <br /> With the Plan Amendment application, applicants submitted a copy of the Cooperative <br /> Improvement Agreement (CIA) as Exhibit E to the original application. The CIA provides that <br /> the City shall install the signal at the intersection at the time the signal warrants indicate that the <br /> traffic volumes require the signal. Applicants believe that the CIA resolves the issue raised by <br /> ODOT's email that was included in the applicants' hearing materials. While a date is not set for <br /> when the signal will be installed, the City is committed to installing the signal when traffic <br /> volumes warrant. The actual date of installation depends on how development occurs in the area. <br /> The applicants believe that ODOT's concerns are addressed by the CIA and the City's <br /> recognition of its obligations under the CIA. <br /> <br /> Concerning local traffic issues, the applicants have proposed a solution to Public Work's <br /> concerns about keeping commercial traffic separate from residential traffic in the area. That <br /> proposal is presented in the first supplemental application material's amended transportation <br /> study. Consistent with that approach, it is appropriate for the City to make findings that the <br /> traffic conditions in the area will require that any development proposed for the subject property <br /> must include a Traffic Impact Analysis Review Application, consistent with the provisions of EC <br /> 9.8650 through EC 9.8680, to assess and mitigate the commercial traffic impacts resulting from <br /> the development proposal. That finding is due in part to provisions contained in the CIA that <br /> require the City to monitor "other" development proposals in the area. <br /> <br /> Furthermore, to ensure that the solution proposed by the amended transportation study can be <br /> implemented at the time of development, the zone change application approval should contain a <br /> condition of approval that requires the applicants to obtain and record an easement on Tax Lot <br /> 400, to the benefit of the subject property, that allows commercial traffic to travel across Tax Lot <br /> 400 in the manner described by the May 7, 2004, amended traffic study. <br /> <br /> Conclusion <br /> <br /> With this submission, the applicants believe that they have responded to all of the issues <br /> raised by the Planning Commissioners at the public hearing. Most importantly, applicants <br /> believe that they have demonstrated that the proposals satisfy all of the approval criteria for both <br /> applications. The applicants request that the Planning Commission recommend that the City <br /> Council approve RA 04-1 and Z 04-4. <br /> <br /> <br />
