Comment 2 : Mark Hudson expressed concern that the fee schedule <br />amendments pose an unfair burden on lower income rate payers compared to <br />higher income and commercial rate payers because the rates for large residential <br />and commercial /industrial are lower than those of small and medium residential. <br />Response The proposed amended rates posted in the notice inadvertently <br />omitted the phrase "per 1,000 square feet" from the impervious surface rates for <br />large residential and commercial /industrial users and from the street - related rate <br />for commercial /industrial users. The fee schedule attached to this Order has <br />been corrected to clarify that impervious surface rates for small and medium <br />residential are charged a flat rate, whereas impervious surface rates for large <br />residential and commercial /industrial are charged a rate per 1,000 square feet. In <br />addition, the street - related rate for commercial /industrial is charged per 1,000 <br />square feet, whereas the street - related rates for small, medium and large <br />residential are flat rates. <br />E. Pursuant to EC 6.411 (1), the amended charges were determined after conducting <br />an investigation of the revenue needs of the City in providing the stormwater services. Based on <br />that investigation and the applicable criteria set out in EC 6.411(2), I find that the amended <br />Stormwater User Fee Schedule attached as Exhibit A should be implemented and effective for all <br />bills issued on or after September 1, 2014. <br />On the basis of these findings, I order that: <br />1. A copy of this Order shall be forwarded to the Mayor and City Councilors. <br />Unless reviewed by the Council, this Order shall become effective on the 11th day after the date <br />it is rendered. <br />2. Notwithstanding the effective date of this Order as set forth above, the <br />Stormwater User Fees attached as Exhibit A are established as the fees to be charged for the <br />described services, effective for all bills issued on or after September 1, 2014. <br />3. Any unamended fees established by Administrative Order No. 58- 12 -03 -F remain <br />in full force and effect and are incorporated into the updated fee schedule attached as Exhibit A. <br />4. Administrative Order No. 58- 12 -03 -F is repealed as of the effective date of the <br />fees attached as Exhibit A to this Order. <br />Dated this Q'7r ,4day of July, 2014. <br />Jon R.
