Administrative Order No. 44 -14 -05 <br />of the <br />City Manager <br />DELEGATING AUTHORITY TO CITY ENGINEER MARK <br />SCHOENING TO REVIEW AND MAKE A DETERMINATION ON TWIN <br />OAKS CONSTRUCTION & METALWORKS' APPEAL OF PROTEST <br />CONCERNING SPENCER BUTTE TRAIL PROJECT, #4884. <br />The City Manager of the City of Eugene finds that: <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, <br />the City Manager is designated as the administrative head of the City, specifically authorized to <br />appoint and remove all employees (except as otherwise provided in the Charter), organize, and, <br />as deemed necessary, disband and reorganize various City departments, and to enforce all <br />ordinances of the City. <br />B. On June 29, 2005, Administrative Order No. 44 -05 -05 was issued delegating to <br />the Manager of the Purchasing Section of Central Services the authority to hear and decide <br />protests of solicitations and protests of awards. <br />C. Section 13.1.7 of Public Contract Administrative Rule R -1415, adopted by <br />Administrative Order No. 44- 08 -06 -F, provides that if the Purchasing Agent is the City <br />Manager's designee, contractors may appeal the Purchasing Agent's denial of a protest to the <br />City Manager. <br />D. On June 25, 2014, Twin Oaks Construction & Metalworks submitted an appeal to <br />the City Manager of the Purchasing Agent's denial of protest concerning the Spencer Butte Trail <br />Project, #4884. <br />E. I find that City Engineer Mark Schoening is qualified to act as my designee to <br />review, and make a determination on, this appeal. <br />NOW THEREFORE, <br />The City Manager of the City of Eugene Orders and Directs that City Engineer Mark <br />Schoening is delegated my authority to review, and make a determination on, the appeal of Twin <br />Oaks Construction & Metalworks regarding denial of its protest of the Spencer Butte Trail <br />Project, #4884. <br />Dated and effective this 24 " day of , 2014. <br />Jon R.
