EUGENE CITY COUNCIL <br />AGENDA ITEM SUMMARY <br /> <br /> Public Hearing: An Ordinance Amending the Laurel Hill Plan Land Use Diagram to <br />Redesignate Property Identified as Tax Lots 199, 200, 300, Assessor's Map 18-03-03-23 <br />From Low-Density Residential to Commercial and to Rezone the Property from R-1 Low <br /> Density Residential to C-2 Community Commercial; Adopting a Severability Clause; <br /> and Providing an Effective Date <br /> <br />Meeting Date: November 15, 2004 Agenda Item Number: 1 <br />Department: Planning and Development Staff Contact: Patricia Thomas <br />www. cl. euget~e, or. us Contact Telephone Number: 682-5561 <br /> <br />ISSUE STATEMENT <br />On November 15, 2004, the Eugene City Council will hold a public hearing on an ordinance to amend <br />the Laurel Hill Plan to change the land use designation from Low Density Residential to Commercial; <br />and change the zone of the Furtick/Larson property from R-1 Low Density Residential to C-2 <br />Community Commercial. <br /> <br />BACKGROUND <br />This item has not previously come before the City Council. Action by the City Council is scheduled for <br />November 22, 2004. <br /> <br />The Planning Commission deliberated on these requests on October 25, 2004, after hearing testimony at <br />a public hearing on September 14, 2004. The Planning Commission voted 4 to 2 to recommend to the <br />City Council approval of the refinement plan amendment and zone change requests. Commissioners <br />Lawless, Levis, McMillan, Rusch voted in favor, commissioners Belcher and Colbath in opposition. <br />Commissioner Duncan was absent. <br /> <br />During their deliberation, in which the commissioners generally agreed that the site is not well suited for <br />residential development, some commissioners discussed the following issues: <br /> <br /> · Lack of understanding of what "public need" for designating the site commercial means; <br /> <br /> · The inability to consider mitigation requirements, such as buffering or a site review overlay, as a <br /> condition of the requested refinement plan amendment or zone change; <br /> <br /> · Frustration that the neighborhood refinement plan is out of date and hampers appropriate <br /> decision-making; and <br /> <br /> · The inability to consider this refinement plan designation change in the context of the entire <br /> refinement plan, rather than an independent change to one site. <br /> <br /> L:\CMO\2004 Council Agendas\M041115\S041115A. doc <br /> <br /> <br />
