Attachment <br /> lane Code <br /> 4.700(2) Lane Code 14.700(3) <br /> <br /> · (c) ' The Approval Authority who reviews the application for <br /> the modification of conditions shall be the same Approval Authority <br /> who made the final land use decision. <br /> (d) An excepti°n to subsections Co) and (c),in this paragraph <br /> is an application for an extension of the developmentperiod. Approval <br /> of an extension shall be done by the Director and is not subject to <br /> appeal. The Director may grant an extension subject to compliance <br /> with the following requirementS: <br /> (i) The Director determines that the applicant was <br /> unable to begin or continue development during the approval <br /> period for reasons for which the applicant was not responsible; <br /> (ii) One extension period may be granted for up to <br /> twelve months; and <br /> · (iii) Additional one-year extensions may be authorized <br /> where applicable criteria for the decision have not changed. <br /> "..~ (3) . Revocation or Suspension. <br /> (a) The Director may suspend or revoke approval of an <br /> application which was initially reviewed and approved or denied <br /> pursuant to LC 14.100 above and/or approved upon appeal. When ' <br /> taking such action, the Director shall follow LC 14,100(3) and (4) <br /> above in giving notice and addressing one or more application conflicls <br /> with the following criteria: <br /> (i) The site has been developed in a manner not <br /> · authorized by the approval of the application; <br /> (ii) The applicant has not complied with the conditions of <br /> .~the approval; ' <br /> (iii) The applicant has secured the approval with false or <br /> misleading information; or <br /> (iv) The application was ~pproved in error. <br /> The Director's decision to suspend or revoke approval is <br /> appealable to the Hearings Official in the same manner pwvided/n LC <br /> 14.500 above for appeals to the Hearings Official. <br /> <br />16-83; 9.14.83 14-33 WP l/co/OO029fr <br />10-89; 10.4.89 <br />4-96; 11..29.96 ZV-ll9 <br /> <br /> <br />
