approval criteria, which were outlined in the Agenda Item Summary and Exhibit C of the draft ordinance <br />distributed at the beginning of the hearing. Ms. Adams noted that the draft ordinance distributed at the <br />hearing differed slightly from the ordinance included in Attachment A of the Agenda Item Summary. <br />She said that in the revised ordinance, the Purpose section now included a reference to the HRB's <br />Designation of the Kaufman House. She added that both the ordinance before the Planning Commission <br />and the ordinance in the Agenda Item Summary differ from the application materials that were provided <br />for creation of the historic zone, noting that the Use Table and Purpose section in particular had some <br />changes. She said that the changes were the result of discussions with the City Attorney's office, <br />Historic Preservation and Land Use Management staff, and questions that arose from public testimony. <br /> <br />Ms. Adams said that the City Council hearing for the proposed land use actions was tentatively scheduled <br />for November 22, 2004, and final action was scheduled for December 6, 2004. She said that meant the <br />Planning Commission was being asked to deliberate and forward a recommendation following today's <br />public hearing. <br /> <br />Ms. Adams stated that three letters had been received since the Agenda Item Summary had been <br />prepared. Those three letters were distributed at the October 25, 2004 Planning Commission work <br />session and to Mr. Duncan today. The testimony included a letter from the Jefferson Westside Neighbors <br />that expressed support for the proposed land use actions, with objections to certain proposed uses without <br />further City review. The remaining two letters were submitted on behalf of the property owner, the City <br />of Eugene, and the tenant, the Emerald Empire Council of the Aging (EECA), in response to the <br />testimony from the neighborhood association, and in support of the proposed land use actions. <br /> <br />Ms. Adams expected that the majority of the testimony at the public hearing would be related to the <br />proposed use question and she was prepared to respond to questions as needed. She added that Historic <br />Special Area zones were intended to provide a range of uses and standards which were more appropriate <br />for historic properties than would otherwise be provided in existing zoning districts. She said many of <br />the permitted uses would otherwise be provided in existing zoning districts, adding that many of the uses <br />that would be permitted in existing R-2 and R-3 zoning were not compatible with the historic features of <br />the Historic Kaufman House and grounds, and would leave property owners wishing to preserve historic <br />properties few options.
