Kaufman Senior Center Page 3
Special Area Zone Response to Public Testimony

uses would make the property more difficult to sell if the city must consider sale in the
future.

c. Designation of these uses as conditional is the only way to allow JWN to have an
effective voice in the future use of this dominate (sic) neighborhood property. The cost,
delay and uncertainty to a potential purchaser presented by the City's conditional use
permit process is within the control of the City.

The last sentence is incorrect. The city must charge permit fees according to its adopted
fee schedule, and must follow land use procedures as outline din the code. The CUP
process is a discretionary, Type III process that does not guarantee a particular outcome.

d. Absent designation of office uses as condition, the only City review over the use of this
property would pursuant to an occupancy permit for compliance with parking
requirements. Only ifa new user proposed to make exterior modifications or proposed
new construction in the historic garden, requiring application for a historic alteration,
would there be neighborhood input as Type II application. The historic alternation (sic)
process presents a potential purchaser with the same uncertainty as the CUP process
the City argues would make the property impossible to sell.

This paragraph does not accurately reflect the review processes proposed for this Special
Area Zone. Any change of use or occupancy would be required to be reviewed under the
land use code and the building code. In addition, requiring a CUP for small offices
proposed in conjunction with EECA would pose logistical problems due to shared use of
portions of the facility.

Thank you for your time. We look forward to presenting testimony at your October 26th heating.
Emmy Jenson (682-5190) and I are both available to answer any questions you may have.

Sincerely,
Terd L.
