Designation of these uses as conditional is the only way to allow JWN to have an <br /> effective voice in the future use of this dominate (sic) neighborhood property. The cost, <br /> delay and uncertainty to a potential purchaser presented by the City's conditional use <br /> permit process is within the control of the City. <br /> <br /> The last sentence is incorrect. The city must charge permit fees according to its adopted <br /> fee schedule, and must follow land use procedures as outline din the code. The CUP <br /> process is a discretionary, Type III process that does not guarantee a particular outcome. <br /> <br /> d. Absent designation of office uses as condition, the only City review over the use of this <br /> property would pursuant to an occupancy permit for compliance with parking <br /> requirements. Only ifa new user proposed to make exterior modifications or proposed <br /> new construction in the historic garden, requiring application for a historic alteration, <br /> would there be neighborhood input as Type II application. The historic alternation (sic) <br /> process presents a potential purchaser with the same uncertainty as the CUP process <br /> the City argues would make the property impossible to sell. <br /> <br /> This paragraph does not accurately reflect the review processes proposed for this Special <br /> Area Zone. Any change of use or occupancy would be required to be reviewed under the <br /> land use code and the building code. In addition, requiring a CUP for small offices <br /> proposed in conjunction with EECA would pose logistical problems due to shared use of <br /> portions of the facility. <br /> <br /> Thank you for your time.
