Finding#51.TheMetroPlanWillametteRiverGreenway,RiverCorridorsandWaterwaysElement <br />(SectionIIID)includespoliciesforadministeringtheWillametteRivercorridorasitpassesthroughthe <br />EugeneSpringfieldarea.Theproposedamendmentsdonotchangethesepolicies. <br />Goals16through19ʹEstuarineResources,CoastalShorelands,BeachesandDunes,andOcean <br />Resources. <br />Finding#52.Therearenocoastal,ocean,estuarine,orbeachandduneresourceswithintheEugeneor <br />SpringfieldUrbanGrowthBoundariesortheMetroPlanBoundary.Thesegoalsdonotapplytothis <br />proposal. <br />Conclusion: <br />TheproposedamendmentstotheMetroPlanareconsistentwiththestatewideplanning <br />goalsadoptedbytheLandConservationandDevelopmentCommission. <br />Criterion#2.͞ĚŽƉƚŝŽŶoftheamendmentmustnotmaketheMetroPlaninternally <br />ŝŶĐŽŶƐŝƐƚĞŶƚ͘͟ <br />Findings: <br />Finding#53.TheMetroPlanEnablingAmendmentsmakechangestoeverychapteroftheMetroPlan <br />tosomedegreetoenablethegradualtransitionfromasharedmetropolitanUGBwithasingle <br />comprehensiveplantoaplanningframeworkwithtwoseparateUGBs(theEugeneUGBandthe <br />SpringfieldUGB).Asthetransitionoccurs,theMetroPlanwillbeamendedseveraltimestoreflectthe <br />evolvingextenttowhichitcontinuestoapplytoeachjurisdiction. <br />Finding#54.TherevisionsproposedthroughoutthePlanarelimitedtothosethatfitwithinatleast <br />oneofthefollowingcategories: <br />1.Revisionstoensurethateachcitycan,independentlyoftheother,establishcityspecificplansand <br />establishthatsuchplanssupplantspecificportionsoftheMetroPlanforthatcity; <br />2.Revisionstoupdateandaddexplanationsofthepast,currentandfuturestatusoftheMetroPlan, <br />includinganexplanationofthestagesofchangeanticipatedasthecitiesconductindependentplanning <br />fortheirseparateƉŽƉƵůĂƚŝŽŶƐ͛needs. <br />3.Revisionstochangeorremovetextthatcannolongerbeappliedduetoachangeinthelawand <br />thatcouldnot(evenarguably)raiseapolicyconcern.Thisincludesthedeletionoftextrelatingtothe <br />nowdefunctLaneCountyBoundaryCommission. <br />Finding#55.Theproposedamendmentswerepreparedwiththeaidofaconsultingattorneywhois <br />familiarwiththeMetroPlanandwiththemandateposedbythepassageofORS197.304.The <br />amendmentsthatweredevelopedhavebeenreviewedbystaffandbyattorneysforEugene,Springfield <br />andLaneCounty.ItistheopinionofstaffandcounselthattheproposedamendmentsleavetheMetro <br />Planinternallyconsistent. <br />Conclusion: <br />TheproposedMetroPlantextamendmentsdonotmaketheMetroPlaninternally <br />inconsistent. <br />MetroPlanEnablingŵĞŶĚŵĞŶƚƐͶ^ƚĂĨĨFindings <br />{00142030;1} <br />November10,2014Page13 <br />
