early February 1997. 'The City:council held a second public hearing and adopted the code <br />amendments on February 24, 1997. ' <br /> <br />Overview of the CiW's Regulations for Teleconununieations Facilities <br />Siting requirements and procedures for telecommunications devices are found in Section 9.5750 <br />of the Eugene Code I971. These sections were renumbered and reformatted.for the newLand <br />Use COde, effective August 1, 2001, but the requirements were not changed. A copYof <br />Ordinance No. 20078, adopting the code provisions, was distributed in October 2001. The Land <br />Use Code can be accessed at: www. ci.eugene.or.us\cityreco\citycode~index.htm~contents. The <br />following is a brief overview of the key featUres of the City's regulations. <br /> <br />Tiered Review Process: A tiered review process was. established to recognize that some types of <br />telecommunication'facilities, in some locations, may require more detailed review and a greater. <br />opportunity for public involvement than others. Under this approach, some types of facilities are <br />permitted uses; some require Site Review, an adminislr~ve decision with appeal to ,the Hearings <br />Official, and Some require Conditional. Use review, a Hearings Official'decision with appeal to' <br />the Planning Commission. 'For exsmPle, collocation of an antenna on an existing transmission <br />tower is a permi~ use in most non, residential zones; while constmction of a new transmission <br />tower or modification to an existing trsn.~mission tower'is a conditioual use in' the R-I zone. <br />This approach provides an incentive to collate new antennas wh.~.e possible, rather than. <br />constructing new towers and an incentive to locatenew towers' inindustrial,areas where they <br />would likely have~a lesser impact than in other areas of the comm~ty. <br /> <br /> Application Requirements: The code contains a detailed list of information required for all ~ ...... <br /> applications. More detailed information is requiredfor.facilities that require Site Review or <br /> Conditional Use review, including: a visual study showingthe appearance of the proposed <br /> facility from at least 5 points.within a 3-mile radius; evaluation of alternafi've sites; evaluation of <br /> co-location options.; an overall system plan for the city, showing existing and planned facilities. <br /> <br /> ~tdardsfor' Telecommunications Facilities: The code includes a series of standards that <br /> govern the installation, Construction or modification of telecommunications facilities. As with <br /> the tiered review process, some standards differ from zone to zone. Nor example, standards for <br /> locating a new telecommunications tower in a low-density residential zone are more restrictiVe <br /> 'with re.~ to tower height, setback and buffering than standards for a new t~lecommunications <br /> tower in an industrial district <br /> <br /> RemOval: To ensure that, over the long term as technology changes,'teieCommunications <br /> facilities are removed when they are not longer in use, the Code allows the City to require that <br /> telecommunication providers post a bond to ensure that removal occurs, particularly for towers <br /> · located in residential areas. Bonds to ensure removal were also required as part of the <br /> Conditional Use approval for towers that were exempted from the moratorium. <br /> <br /> Recovery of City Cost for Fa'pert Advice: The code allows the recovery of full cost of retaining <br /> consultants to verify statements made in conjunction with a building permit or land use <br /> application for a telecommunications facility. ... <br /> <br /> IV-31 <br /> Eugene City Council Agenda page22 <br /> <br /> <br />
