In the interim the DOT's Federal Highway Administration (FHWA) has advised, in response to an <br />inquiry from the City (April, 2012), that "...While the FHWA has not issued any guidance <br />document on this issue, we are advising ... that either the 2005 Revised Draft Guidelines for <br />Accessible Public Rights -of -Way (2005 PROWAG2) or the 2011 Proposed Accessibility Guidelines <br />for Pedestrian Facilities in the Public Right -of -Way (2011 NPRM) should be considered best <br />practices for new construction and alteration of facilities within the public rights-of-way in order <br />to ensure ADA compliance." <br />It is specifically noted in the guidelines that the proposed guidelines do not address existing <br />facilities unless they are included within the scope of an alteration undertaken by the agency. <br />This standard has been typical of all previously adopted or proposed guidelines in that the <br />guidance only applies to new or altered facilities. <br />2.2 State <br />Oregon Revised Statutes Chapter 447 - Standards and Specifications for Access by Persons with <br />Disabilities (sections 447.210 to 447.310) <br />477.310 Standards for Curbing: Provided for the construction of curb cuts or ramps and <br />minimum standards for those items whenever a curb or sidewalk is constructed or replaced at <br />any point in a block which gives reasonable access to a crosswalk. <br />2.3 City <br />Eugene Code (EC) Chapter 7 - Public Improvements <br />7.090 Temporary Work: Specifies that construction activities shall not impede safe and <br />accessible pedestrian movement and that when such activities block public sidewalks that ADA - <br />accessible routes shall be provided. Temporary events and facilities such as street fairs, <br />parades, and vending carts must also meet accessibility criteria. <br />7.365 Americans with Disability Act (ADA) Ramp Standards: Outlines the requirement for <br />privately engineered public improvements to include the design and construction of (or provide <br />funding for) ADA access ramps within and adjacent to the development site. Owners of single <br />corner lots and lots facing t -intersections are also required to construct ADA access ramps as <br />part of their sidewalk construction. <br />Public Improvement Design Standards (P1DS) Manual <br />Initially adopted in 2007 by Administrative Order and most recently updated in 2011, this <br />manual imposes requirements and restrictions with respect to the design, location, and <br />construction of public improvements as per EC 7.085. Details of ADA—compliant design <br />standards and references to ADA -related publications are provided throughout the manual. <br />Standard Specifications for Construction — February 2, 2015 <br />The City's current specifications for construction are comprised of the 2015 Oregon Standard <br />Specifications for Construction (Oregon Specifications) as modified by City drawings and <br />Amendments. <br />Eugene Arterial and Collector Street Plan (ACSP) —1999 <br />Most recently updated in 1999, this plan supports provision of facilities for people with <br />disabilities in all street improvement and construction projects.
