otherwise require paving and other improvements that would diminish the historic character of the site <br />and would harm the existing 54" diameter fir tree located in the existing gravel parking area. This <br />exemption is only allowed for specialty retail, and specialty food and beverage land uses. As noted in <br />the ordinance, specialty food and beverage use of the property is limited to a maximum of only 850 <br />square feet. The development of other land uses would require an adjustment review application if an <br />exemption to the parking lot standards was requested by the property owner. The list of permitted land <br />uses established in the S-HJM ordinance was derived from the C-1 Neighborhood Commercial zoning, <br />but the S-HJM zoning would not allow the full range of C-1 zoning land uses on the property. <br /> <br />Additional information, including the historic background of the property, is attached in exhibits to the <br />ordinance and in the Planning Commission packet prepared for the November 16, 2004 public hearing. <br /> <br />RELATED CITY POLICIES <br />The proposed land use actions are supported by the following Council Goal: <br /> <br /> SUSTAINABLE COMMUNITY DEFELOPMENT <br /> A community that retains a high quafity of life anda healthy economy, effectively fink; landuse and <br /> transportation planning, and succes,fully manages growth and change in the urban environment. <br /> <br />The proposed land use actions further the policy direction in the Historic Preservation Element of the <br />Metro Plan with the goal of preserving significant reminders of the City's origins as links between past, <br />present, and future generations. The land use actions would also be consistent with land use policies of <br />the River Road - Santa Clara Urban Facilities Plan. Exhibit C of the attached ordinance includes related <br />plan policies, Eugene Code criteria, and findings explaining how the proposed land use actions are <br />consistent with City policies and criteria. <br /> <br />COUNCIL OPTIONS <br />No action is requested of the council as this is a public hearing only. Action by the council is scheduled <br />for January 24, 2005. <br /> <br />CITY MANAGER'S RECOMMENDATION <br />Given the site-specific nature of the proposed zoning, the minimum requirements for quasi-judicial <br />action must be followed for the public hearing. The City Council is scheduled to take final action on the <br />ordinance and zone change at its January 24, 2005, meeting. The final action to approve, approve with <br />modifications, or deny the proposed land use actions, will be based on applicable approval criteria. The <br />applicable approval criteria and findings are contained in Exhibit C of the ordinance and are generally <br />discussed in the Agenda Item Summary of the Planning Commission's November 16, 2004, public <br />hearing packet. <br /> <br />SUGGESTED MOTION <br />No action is requested of the council.
