The proposed code amendment will establish a zone change criterion that references the siting <br />requirements in uncodified site-specific S-H Historic Special Area Zones. This code amendment <br />will ensure that site-specific S-H Historic Special Area Zones are applied only to the designated <br />site. This means that only the Johansen-Moody House would qualify for the site-specific S-HJM <br />Historic Johansen-Moody House Special Area Zone. <br /> <br />The zone change approval criteria at EC 9.8865 provide that a proposed zone change shall be <br />consistent with applicable siting requirements, with reference to the code sections corresponding <br />with the siting requirements in each zone set forth in the land use code. However, the zone change <br />approval criteria make no reference to the siting requirements for uncodified site-specific S-H <br />Historic Special Area Zones. The proposed code amendment will amend Eugene Code section <br />9.8865 to include this reference. Specifically, the following addition to EC 9.8865(4) is proposed <br />in the draft ordinance within Attachment A-1: <br /> <br /> (p) An uncodified ordinance establishing a site-specific S-H Historic Special Area Zone, a <br /> copy of which is maintained at the city's planning and development department. <br /> <br />The Eugene Code provides that if the City Council elects to act, it may, by ordinance, adopt an <br />amendment to this land use code that complies with the following criteria from EC 9.8065: <br /> <br /> (1) Is consistent with applicable statewide planning goals as adopted by the Land <br /> Conservation and Development Commission. <br /> <br /> (2) Is consistent with applicable provisions of the Metro Plan and applicable adopted <br /> refinement plans. <br /> <br /> (3) In the case of establishment of a special area zone, is consistent with EC 9.3020 Criteria <br /> .for establishment of an S Special Area Zone. <br /> <br />Planning staff conclude that the proposed code amendment complies with the applicable approval <br />criteria, finding that neither the Statewide Planning Goals nor applicable adopted plans include <br />provisions that are directly applicable to the proposed code amendment. Moreover EC 9.8065(3) is <br />not applicable. However, the applicant's written statement includes an evaluation of the proposed <br />S-HJM Zone for consistency with the code amendment approval criteria. Because the provisions <br />of the proposed S-HJM Zone will not be codified, these findings of compliance with the code <br />amendment criteria are not required. Staff findings and conclusions for the proposed code <br />amendment will be incorporated in Exhibit B of the draft ordinance. <br /> <br />Zone Change: The proposed zone change would apply the proposed S-HJM Historic Johansen-Moody <br />House Special Area zone to the City Landmark property at 370 River Road. Approval of a zone change <br />application shall not be approved unless it meets all of the following criteria from EC 9.8865: <br /> <br /> (1) The proposed change is consistent with applicable provisions of the Metro Plan. The <br /> written text of the Metro Plan shall take precedence over the Metro Plan diagram where <br /> apparent conflicts or inconsistencies exist. <br /> <br /> 5 5 <br /> <br /> <br />
