City of Eugene - Johansen-Moody House Page 9 <br />Code Amendment/Zone Change: Creation of Historic Special Area Zone <br />Satre Associates, P.C. September 17, 2004 <br /> <br /> "Maintain existing land use patterns until completion of the Chambers <br /> Connector. The effects of the Chambers Connector and related road <br /> improvements on the immediate area should be examined upon completion <br /> of final design and right-of-way acquisition and any appropriate changes <br /> adopted." <br /> <br /> To the extent that this recommendation is construed as policy, the proposed <br /> rezone is consistent with the direction contained therein, considering the site- <br /> specific information presented in this application. <br /> <br /> (3) The uses and density that will be allowed by the proposed zoning in the location of the <br /> proposed change can be served through the orderly extension of key urban facilities and <br /> services. <br /> <br /> The Johansen-Moody House exists and is currently served by all required urban facilities <br /> and services, including streets, water, sewer, stormwater facilities, electric and phone <br /> service, waste disposal service, land use controls, schools and parks. Future reuse of the <br /> property would be served by these existing services, in compliance with the above <br /> criterion. <br /> <br /> (4) The proposed zone change is consistent with the applicable siting requirements set out for <br /> the specific zone in: <br /> <br /> The Applicant notes that this application complies with the siting standards proposed to <br /> be adopted for the Special Area Zone (see Attachment E). <br /> <br /> (5) In cases where the NR zone is applied based on EC 9. 2510(3), the property owner shall <br /> enter into a contractual arrangement with the city to ensure the area is maintained as a <br /> natural resource area for a minimum of 50 years. <br /> <br /> The NR zone does not apply and is not proposed to apply to the subject properties; <br /> therefore, this criterion is not applicable. <br /> <br />Code Amendment Criteria <br /> <br />9.8065 Code Amendtnent Approval Criteria. If the city council elects to act, it may, by <br />ordinance, adopt an amendment to this land use code that: <br /> <br /> (1) Is consistent with applicable statewide planning goals as adopted by the Land <br /> Conservation and Development Commission. <br /> <br /> Goal 1 - Citizen Involvement: To develop a citizen involvement program that insures the <br /> opportunity for citizens to be involved in all phases of the planning process. <br /> <br /> The City of Eugene land use code implements Statewide Planning Goal 1 by requiring <br /> that notice of the proposed amendments be given and public hearings be held prior to <br /> adoption. By complying with the submittal requirements contained in the Eugene Code, <br /> <br /> 27 <br /> <br /> <br />
