ExhibitC <br />arerelatedtoplanningforhigherdensityhousing.Iftheyarefoundtobeapplicable,theyaremetas <br />indicatedintheğƦƦƌźĭğƓƷ͸ƭwrittenstatementwhichisincorporatedhereinbyreference. <br />MetroPlanAmendmentConclusion <br />Basedontheabovefindings,theproposed MetroPlan diagramamendmentisconsistentwithEC <br />9.7730. <br />ZoneChange(fileno.Z151) <br />Theproposalincludesrezoningofapproximately27.63acresofthe73.9acresitefromPLPublicLand <br />toR1LowDensityResidential,sothattheentirepropertywillbezonedR1LowDensityResidential. <br />Mostofthatpropertyforrezoninglieswithintheportionofthepropertycurrentlyinactivecemetery <br />useorplattedwithcemeterylots.EC9.8865requiresthatthezonechangeproposalsmeetthe <br />followingapprovalcriteria(listedin boldanditalic).Findingsareprovidedbelowwithrespectto <br />eachoftheapplicablecriteria. <br />(1)TheproposedchangeisconsistentwithapplicableprovisionsoftheMetroPlan.Thewritten <br />textoftheMetroPlanshalltakeprecedenceovertheMetroPlandiagramwhereapparent <br />conflictsorinconsistenciesexist. <br />Someofthepoliciesaddressedinthe MetroPlan amendmentfindingsareapplicablehere,andtothe <br />hereinbyreferenceas <br />extenttheyareapplicablethefindingsunderEC9.7730(3)(b)areincorporated <br />demonstrationofconsistencywithapplicable MetroPlan policies. <br />(2)Theproposedzonechangeisconsistentwithapplicableadoptedrefinementplans.Inthe <br />eventofinconsistenciesbetweentheseplansandtheMetroPlan,theMetroPlancontrols. <br />Approvalofthezonechangeisdependentuponapprovalofthe MetroPlan landusediagram <br />amendments.Theapplicablerefinementplan,theSouthHillsStudy,doesnothaveanadoptedland <br />usediagram.Thereforetheproposaldoesnothavetoaddressconsistencyoramendarefinement <br />planlandusediagram. <br />TheapplicantalsoaddresstheproposedredesignationandrezonewithrespecttotheSouthHills <br />StudyPolicies(13)regardingpropertyoverВЉЊ͸elevation,density,andcriteriaregardingwhen <br />certainlanduseapplicationsareapplicable(suchassubdivision,siterevieworplannedunit <br />development).Theapplicantstatesthatthesepoliciesareeithernotapplicabletothesubject <br />propertyormaybeapplicableasdeterminedatthetimeofdevelopment.Staffgenerallyconcurs <br />withthisandtheğƦƦƌźĭğƓƷ͸ƭfindingsareincorporatedhereinbyreference.Specifically,staffconcurs <br />thatwhetherornotdevelopmentonthesitetriggerstheneedforasubdivision,sitereviewor <br />plannedunitdevelopmentisaquestiontobedeterminedatthetimeofdevelopmentandtherefore <br />anoverlayzonerequiringanyoftheseapplicationsisnotnecessary.Stafffurtherconcursthatthere <br />isnopolicybasisintheapplicableadoptedplansthatcallfortheimpositionofanoverlayatthetime <br />ofrezoning. <br />Basedontheabove,theadoptedrefinementplaniseithernotapplicableortheproposalis <br />consistent. <br />Findings11 <br />
