ADMINISTRATIVE ORDER NO. 21-16-01 <br />of the <br />City Manager of the City of Eugene <br />REPEAL OF SICK LEAVE ADMINISTRATIVE RULE R-4.582 <br />ESTABLISHED BY ADMINISTRATIVE ORDER NO. 21-15-01-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.019 of the Eugene Code, 1971 ("EC"), authorizes the City Manager to <br />adopt rules for implementation of any provisions of that Code. <br />B. On July 28, 2014, Ordinance No. 20537 was adopted establishing minimum <br />standards for sick leave for employees who work inside the City. The Ordinance provided that the <br />Sick Leave provisions (EC 4.570 through 4.584) not become effective until July 1, 2015. <br />C. Pursuant to EC 2.019 and 4.582, on January 31, 2015, Administrative Order No. <br />21-15-01-F was issued establishing Sick Leave Administrative Rule R-4.582. <br />D. On June 17, 2015, Ordinance No. 20553 was adopted amending Ordinance No. <br />20537 to provide that the City's sick leave provisions not become effective until January 1, 2016, <br />and that Ordinance No. 20537 be automatically repealed on January 1, 2016, in the event that the <br />B -Engrossed version of SB 454 (requiring all Oregon employers to implement paid sick time for <br />employees) was signed into law by the Governor and not referred to the voters. <br />E. SB 454 was signed into law by the Governor and was not referred to the voters. <br />Therefore, Ordinance No. 20537 and the City's sick leave provisions were automatically repealed <br />on January 1, 2016. The repeal of Ordinance No. 20537 rendered Administrative Order No. 21- <br />15-01-F moot and, as a maintenance matter, that Order should be repealed. <br />On the basis of these findings, I order that Administrative Order No. 21-15-01-F is <br />repealed. <br />Dated this 5'71-1 day of January, 2016. <br />Jon R.
