ADMINISTRATIVE ORDER NO. 58-16-03-F <br />of the <br />Public Works Department <br />City of Eugene <br />REPEAL OF RULES FOR GOLDEN GARDENS PARK IN -WATER DOG <br />TRAINING PERMITS AND ADMINISTRATIVE ORDER NO. 58-13-07-F. <br />The Executive Director of the Public Works Department of the City of Eugene finds <br />as follows: <br />A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt rules <br />and regulations necessary for the administration or enforcement of provisions of the Eugene Code, <br />1971. Pursuant to the authority in Administrative Order No. 21-03-12 issued by the City Manager, <br />the Executive Director of the Public Works Department is authorized to regulate City parks, protect <br />park visitors and the park environment, and adopt rules regarding the use of parks. <br />B. On October 10, 2013, Administrative Order No. 58-13-07-F was issued adopting <br />Rules for Golden Gardens Park In -Water Dog Training Permits for the purpose of establishing a <br />formal permitting process and regulations for the in -water dog training activities taking place at <br />Golden Gardens Park. <br />C. On January 11, 2016, I issued Administrative Order No. 58-16-03, proposing to no <br />longer allow in -water dog training at Golden Gardens Park for the following reasons: (a) <br />participation in the program has declined significantly; (b) on-going impacts to wildlife are not <br />compatible with wildlife and habitat management goals for the site; (c) use by other park users <br />continues to increase creating greater opportunities for conflicts between users; and (d) changes in <br />staffing have eliminated resources to administer the program. In addition, as a result of my <br />proposal to no longer allowing the in -water dog training, I proposed to repeal Administrative Order <br />No. 58-13-07-F and the Rules for Golden Gardens Park In -Water Dog Training Permits. <br />D. Notice of the proposed repeal of the in -water dog training and the Rules for Golden <br />Gardens Park In -Water Dog Training Permits was given by making copies of the Notice attached <br />as Exhibit A to Administrative Order No. 58-16-03 available to any person who had requested <br />such notice, and by publication of the Notice in the Register Guard newspaper on January 14, 15, <br />16, 17 and 18, 2016. The Notice provided that written comments or objections to the proposed <br />Rule be submitted within 15 days of the first date of publication of the Notice. No comments were <br />received within the time or in the manner provided in the Notice. <br />Based upon the above findings which are adopted, and the findings in Administrative <br />Order No. 58-16-03, and pursuant to the authority contained in Section 2.019 of the Eugene Code, <br />1971, and Administrative Order No. 21-03-12, I order that in -water dog training at Golden Gardens <br />Administrative Order - Page 1 of 2 <br />
