Development in the Floodway <br />For work within the floodway a No -Rise Certification and the accompanying analysis must <br />be provided. In order to be approved it must be demonstrated that there will be no (ZERO) <br />increase in water levels at any point during the occurrence of the Base Flood. Even minor <br />increases in water levels upstream or downstream are disallowed. See FEMA's memo <br />Procedures for "No -Rise" Certification For Proposed Developments in the Regulatory <br />Floodway for the necessary guidance. Please note that these procedures require that the <br />original model's HEC -2 data be obtained, the data transferred into the current HEC -RAS <br />version that is approved by FEMA, and many additional time consuming steps. The report, <br />signed certification, HEC -RAS printout and a complete electronic copy of the models must <br />be submitted for review. <br />Watercourse Alteration Requirements <br />CFR Title 44 Part 60.3[b][6] Notify, in riverine situations, adjacent communities and the <br />State Coordinating Office prior to any alteration or relocation of a watercourse, and submit <br />copies of such notifications to the Administrator (FEMA); <br />CFR Title 44 Part 60.3(b)(7) Assure that the flood carrying capacity within the altered or <br />relocated portion of any watercourse is maintained. <br />Eugene Code 9.6707(2) also indicates'In connection therewith, the duties of the building <br />official or designee shall include, but not limited to: (g) Notifying adjacent communities and <br />the Division of State Lands (actually DLCD) prior to any alteration or relocation of a <br />watercourse, and submitting evidence of such notification to the Federal Insurance <br />Administration (now Federal Insurance and Mitigation Agency) (h) Requiring that <br />maintenance is provided within the altered or relocated portion of a watercourse so that <br />the flood carrying capacity is not diminished;' <br />Below is a lengthy excerpt from A Summary of NFIP Policy for Local Officials provided <br />by FEMA Region X. It is intended as guidance to local officials and does not reference local <br />code requirements which maybe more restrictive. <br />Notification. If a development permit application proposes a stream alteration, the <br />local official must notify adjacent communities, the State Coordinating Agency for <br />the NFIP, and provide a copy to the FEMA Regional Office. This provision recognizes <br />that flooding problems do not respect legal boundaries and is intended to make <br />communities aware of proposed stream changes that might create new flood <br />problems or aggravate an existing one in surrounding areas. If an adverse impact is <br />suspected, the neighboring community will be able to voice its concerns prior to any <br />modification. Federal and State permits will usually be required for any alteration or <br />relocation. It is recommended that the community require the submittal and <br />approval of a Conditional LOMR for large-scale proposals (this is approval of the <br />proposal before it is to be built — assures that FEMA will recognize it for a map <br />2016 PIDS Manual, Appendix, B-3 B-3-1 <br />
