(Eugene Code Section 2.973) The chief petitioners shall include with the <br />prospective petition a statement declaring whether one or more persons will be paid <br />money or other valuable consideration for obtaining signatures of electors on the <br />referendum petition. <br /> <br />D Cover Sheet <br />a. (Eugene Code Section 2.973) <br /> <br />D Signature Sheet <br />a. The title of the ordinance to be referred OR the 10 word (or less) Ballot Title. <br />b. A clear statement as to whether petition circulators are being paid. State Form <br />SEL 373 is to be used if some circulators are being paid. State Form SEL 371 <br />is to be used if no circulators are being paid. <br />c. A signed statement by the circulator that all signatures on the sheet were <br />collected in his/her presence. (Eugene Code Section 2.973) <br /> <br />2. BALLOT TITLE <br /> <br />The City Recorder will provide to the City Attorney two copies of the prospective petition and the <br />City Attorney Will, within 5 business days, review the prospective petition for legal sufficiency <br />and, if appropriate, issue a ballot title, question, and explanation of the prospective petition. This <br />text will appear on the ballot at the election for the referendum petition. (Eugene Code Section <br />2.977(1 )). Once the chief petitioners have received written approval to circulate, the ballot title <br />drafting process and the collection of signatures may occur simultaneously, <br /> <br />3. APPEAL OF BALLOT TITLE <br /> <br />Upon receipt of the ballot title, the City Recorder publishes a notice that the ballot title has been <br />received in the next available edition of a newspaper of general circulation. Any elector <br />dissatisfied with the ballot title may, within 5 business days after it is delivered to the City <br />Recorder's Office, submit to the City Recorder a written appeal to the City Council requesting a <br />different ballot title and stating why the ballot title prepared by the City Attorney is unsatisfactory. <br />The council shall afford the appellant a hearing and act on that request within ten business days <br />after the ballot title is delivered to the City Recorder. The ballot title, question and explanation <br />drafted by the council shall be the official ballot language and shall appear before the voters at <br /> <br />1 Eugene Code 2.973(4) allows that each signature sheet may contain the title of the ordinance to be <br />referred instead of the caption of the ballot title. If petitioners place the Ballot Title language on the cover <br />and signature sheet, and the ballot title is later changed by the City Council through the appeal process, all <br />signatures collected with the original language would be invalid.
