<br />ADMINISTRATIVE ORDER NO. 58-07-08-F <br />of the <br />City Manager pro tern of the City of Eugene <br /> <br />INFLATIONARY ADJUSTMENT OF SYSTEMS DEVELOPMENT <br />CHARGES FOR REGIONAL WASTEWATER SYSTEM. <br /> <br />The City Manager pro tern of the City of Eugene finds as follows: <br /> <br />A. Section 2.020 of the Eugene Code, 1971 (EC), authorizes the City Manager of the <br />City of Eugene to determine and set fees and charges to be imposed by the City for services, <br />goods, use of municipal property, and licenses and permits. EC 7.71 O( 5) authorizes the City <br />Manager to adopt by administrative order changes to Systems Development Charge (SDC) rate <br />factors and cost indices. <br /> <br />11 <br /> <br />B. The most recent amendments to the SDC Methodologies were adopted by <br />Resolution No. 4900 effective on May 7, 2007. <br /> <br />C. In accordance with the procedures set forth in EC 2.020 and 7.710(5), on July 23, <br />2007, the City Manager issued Administrative Order No. 58-07-08 and notified the Mayor and <br />City Council that he intended to amend Systems Development Charges for Regional Wastewater <br />System by implementing a 4.2% inflationary increase as set forth in the Notice attached as <br />Exhibit A to that Order. The increase was based on the recommendation of the Metropolitan <br />Wastewater Management Commission (MWMC), and the national 20-city average Construction <br />Cost Index as published by the Engineering News-Record. <br /> <br />D. Notice was also posted at two locations at City Hall and published in the Register- <br />Guard, a newspaper of general circulation within the City, on July 27, 2007. In addition, Notice <br />was made available to persons who requested such notice, and for inspection by interested <br />persons at the office of the City Engineer, Public Works Department, 858 Pearl Street, Eugene, <br />Oregon 97401, during normal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, <br />exclusive of holidays). Notice provided that written comments would be received for a period of <br />15 days from the date of posting and publication. No comments were received within the time or <br />in the manner set forth in the Notice. <br /> <br />E. After considering the applicable policies, enactments and directives of the City <br />Council, the amount charged for these services by the City in the past, the full costs of providing <br />these services supported by the fees, the amounts charged by other comparable providers, and the <br />revenue needs of the City as determined by the adopted City budget, I find that the inflationary <br />adjustments to the Systems Development Charges for Regional Wastewater System are <br />consistent with adopted policies of the City, in conformity with applicable state law, authorized <br />by EC 7.71 O( 5), and should be implemented as proposed effective August 20, 2007. <br /> <br />On the basis of these findings, I order that: <br /> <br />Administrative Order No. 58-07-08-F -- Page 1 of 2 <br />
