Posted in four public places in the city for two successive <br />weeks prior to the hearing date. <br />(3) Territories annexed to the city according to the procedures in EC 9.7800 – <br />9.7835 shall be automatically rezoned as of the effective date of the <br />annexation from Lane County land zones and zoning overlays to <br />equivalent Eugene zones and overlay zones as shown in Table 9.7820 <br />Equivalent Zones and Overlay Zones. For purposes of this section, <br />property that is also within an area identified as a Nodal Development <br />Area on the Metro Plan Diagram shall be automatically included in the <br />Eugene /ND Nodal Development Overlay Zone. The city council shall approve, modify and <br />approve, or deny a proposed annexation based on the application’s <br />consistency with the following: <br />(1) The territory proposed to be annexed is within the city’s urban growth <br />boundary and is: <br />(a) Contiguous to the city limits; or <br />(b) Separated from the city only by a public right of way or a stream, <br />bay, lake or other body of water. <br />(2) The proposed annexation is consistent with applicable policies in the <br />Metro Plan and in any applicable refinement plans. <br />Ordinance - <br />5 <br /> <br />
