<br />Exhibit A <br /> <br />Findings <br /> <br />September 17, 2007 <br /> <br />Summer Oaks Crescent Center (RA 06-4, Z 06-24, CA 07-1) <br />Refinement Plan Map and Text Amendments, Zone Change, Land Use Code Amendment <br /> <br />Refinement Plan Amendment Approval Criteria <br /> <br />The Eugene Code requires that a refinement plan amendment be consistent with Eugene Code (EC) <br />Sections 9.8424(1) and EC 9.8424(2). The proposal is found to be consistent with approval criteria at <br />EC 9.8424(2) and EC 9.8424(1). Findings relative to the amendment criteria (with criteria in bold <br />italics) are presented below. <br /> <br />Consistencv with EC 9.8424(1) <br />EC 9.8424(1) requires that the refinement plan amendment be consistent with all of the <br />following: <br />(a) Statewide planning goals; <br />(b) Applicable provisions of the Metro Plan <br />(c) Remaining portions of the refinement plan. <br /> <br />The proposal is not found to be consistent with refinement plan amendment criteria in EC <br />9.8424(1). Staff findings relative to the amendment criteria (with criteria in bold italics) are <br />presented below. <br /> <br />A. Consistency with Statewide Planning Goals <br /> <br />Goal 1 Citizen Involvement: To develop a citizen involvement program that insures the opportunity <br />for citizens to be involved in all phases of the planning process. <br /> <br />In its land use code, the City has State-acknowledged provisions for citizen involvement that ensure <br />the opportunity for citizens to be involved in all phases of the planning process and that set out <br />requirements for such involvement. The proposed action does not amend these citizen involvement <br />provisions. The process for reviewing the proposed amendment complies with Goal 1 since it complies <br />with, and surpasses the requirements of, the State-acknowledged citizen involvement provisions. <br /> <br />The City of Eugene land use code implements Statewide Planning Goal 1 by requiring that notice of <br />proposed amendments be given and public hearings be held prior to adoption. Consideration of the <br />amendments begins with a City of Eugene Planning Commission public hearing on August 14,2007. <br />On December 12, 2006, the City mailed notice of the proposed plan amendments and zone change to <br />the Department of Land Conservation and Development, as required by the Eugene Code and in <br />accordance with State statutes. Referral comments were requested on June 8, 2007. Referrals were <br />sent to the Oregon Department of Transportation (ODOT), City of Springfield, Lane County, the Cal <br />Young Neighborhood Association and to City departments, consistent with the Eugene Code.
