ATTACHMENT A <br />11/19/07 – V-6 <br /> <br />Section 8. <br /> The legislative findings attached hereto as Exhibit A are adopted in <br />support of this Ordinance. <br />Section 9. <br /> The City Recorder, at the request of, or with the concurrence of the <br />City Attorney, may correct any reference errors contained herein, or in other provisions <br />of the Eugene Code, 1971, to the provisions added, amended, or repealed herein. The <br />City Recorder is specifically authorized to correct references to the Lane County Local <br />Government Boundary Commission. <br />Section 10. <br /> The State Legislature has abolished the Lane County Local <br />Government Boundary Commission, effective January 1, 2008. The City’s ability to <br />accept and process annexation applications serves an important public purpose, and it <br />is therefore necessary that the provisions contained in this Ordinance establishing <br />procedures for the City to effect annexations and withdrawals of territory from public <br />service districts become effective on January 1, 2008, which is less than 30 days from <br />its date of adoption. <br />Section 11. <br /> Pursuant to the provisions of Section 32(2) of the Eugene Charter of <br />2002, with the affirmative vote of two-thirds of the members of the City Council, this <br />Ordinance shall become effective on January 1, 2008. <br />Section 12. <br /> Notwithstanding the effective date of this Ordinance as provided in <br />Section 10, in order to ensure the City’s ability to accept and process annexation <br />applications on January 1, 2008, the City Manager is specifically authorized to establish <br />fees necessary for implementation of the provisions contained herein, in accordance <br />with the provisions of Section 2.020 of the Eugene Code, 1971, to become effective on <br />January 1, 2008. <br />Ordinance - <br />12 <br /> <br />
