Zachary Vishanoff <br />, a resident living on Patterson Street, asked that he be allowed to see the materials he <br />was submitting to the council to ensure they received them. He shared several documents with the council to <br />illustrate his remarks about his concerns about the potential of no-bid contracts such as that he anticipated <br />would be issued for the proposed basketball arena. He wanted Nike to have to abide by the existing laws as <br />he considered the arena to be “a Nike annexation of Eugene by dint of eminent domain.” <br /> <br />Mayor Piercy closed the Public Forum and called on the council for questions and remarks. <br /> <br />Councilor Zelenka clarified that the City of Eugene had nothing to do with the University’s actions in regard <br />to the University’s potential use of eminent domain. He acknowledged his own neighborhood’s concern <br />about the impact of the arena but also noted the neighborhood organization’s tentative support for the arena <br />if its concerns were respected by the University. <br /> <br /> <br />2. Request for Contingency Funds for Cost and Expense Associated with Recruitment and <br />Selection of a New City Manager <br /> <br /> <br />Councilor Pryor, seconded by Councilor Taylor, moved to approve the items on the Consent <br />Calendar with the exception of the minutes from the work session that was held on May 14, <br />2007. <br /> <br />Councilor Bettman noted minutes corrections she had submitted earlier via e-mail, noting the deletion of the <br />correction she had tentatively proposed to the July 23, 2007, work session minutes as that section had been <br />clarified by minutes staff. Mayor Piercy deemed them approved as submitted. . <br /> <br />Roll call vote; the motion to approve the Consent Calendar passed unanimously, 7:0. <br /> <br /> <br />3. ACTION: <br /> <br />An Ordinance Concerning Consumption or Possession of Alcohol in Public Places and Amending <br />Sections 4.190, 4.990, and 4.996 of the Eugene Code, 1971 <br /> <br />Councilor Ortiz joined the council via speakerphone. <br /> <br />Councilor Pryor, seconded by Councilor Taylor, moved that the City Council adopt Council <br />Bill 4053, an ordinance concerning consumption or possession of alcohol in public places. <br /> <br />Councilor Bettman asked City Attorney Jerome Lidz how the ordinance could be interpreted as creating a <br />special class, a violation of the Oregon Constitution.
