<br />category tenants in accordance with the Federal Uniform Relocation <br />Assistance Real Property Acquisition Policies Act, as amended, Fixed <br />Residential Moving Cost Schedule. Also, the TAP contract shall obligate the <br />condominium conversion developer to pay elderly or disabled special <br />category tenants a fixed sum of $500 for packing and unpacking expenses. <br />Moving expenses, including, if applicable, packing and unpacking expenses, <br />shall be paid to the tenant 14 days prior to the tenant's move-out date. <br /> <br />2. WITHDRAWAL OF APPROVAL OF HOUSING COUNSELOR. The City may <br />withdraw approval of the Housing Counselor who is a party to the Housing <br />Counselor contract. Such withdrawal of approval may occur after notice and <br />opportunity to be heard if the City finds that the Counselor has willfully or <br />persistently failed to abide by the terms of his/her contract, alienated a <br />substantial number of tenants so as to impair the effectiveness of the <br />Counselor's performance, or has refused to deal with or ignored the needs of <br />any special category tenant. Applicant agrees to contract on the same terms <br />with another Housing Counselor within a reasonable period of time after City <br />withdrawal of approval of the initial Housing Counselor. The replacement <br />Housing Counselor shall be subject to City approval under Administrative <br />Rule R-1078-0-5. <br /> <br />3. COMPARABLE HOUSING. Applicant agrees to offer independently two <br />comparable housing units to each special category tenant listed on Exhibit <br />8-B prior to giving notice to such a tenant of termination of tenancy. As used <br />herein, "comparable housing" shall be that type of housing defined in Section <br />2.1060 of the Eugene Code, and Administrative Rule R-1 078-0- 6, 7, 8, and <br />9. An independent offer to one which is not an outstanding offer to any other <br />tenant and which is, during the period of consideration, an exclusive offer to <br />that tenant. If the status of the offered unit as comparable is contested by the <br />tenant, it shall not constitute such an offer until the decision of the Hearings <br />Officer on its comparability. The Applicant may evict any tenant at any time, <br />consistent with state law, if such eviction is for good cause as that term is <br />defined in Section 2.1060 of the Eugene Code. Failure of any special <br />category tenant to accept a comparable housing offer within five days of the <br />initial offer shall constitute a rejection unless such tenant is temporarily <br />immobile because of sickness or injury in which case such tenant shall have <br />25 days to consider an offer of comparable housing. <br /> <br />4. LIMITATION ON RENT INCREASES AND EVICTION REMEDIES. Applicant <br />agrees not to evict any affected tenant, except for good cause (as defined in <br />Section 2.1060 of the Eugene Code) prior to the issuance of a condominium <br />conversion permit by the City or the expiration of 180 days from the time the <br />tenant receives the Notice of Planned Condominium Conversion, whichever is <br />later.
