<br />NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a <br />Municipal Corporation of the State of Oregon, as follows: <br /> <br />Section 1. Based upon the above findings which are adopted, and subj ect to the <br />limitation noted below, the City Manager, in cooperation with Lane County, is authorized to <br />submit an application to the Oregon Economic and Community Development Department under <br />the Oregon Enterprise Zone Act, requesting amendment to the West Eugene Enterprise Zone <br />boundary as shown in the attached maps and legal descriptions attached as Exhibits A through D. <br />The City Manager is authorized to submit the application only after (1) the property owner has <br />received final approval for a subdivision of the property identified in Exhibits A and B; and (2) <br />the City of Eugene has received a building permit application for Glorybee Foods for a building <br />that exceeds 100,000 square feet to be located on one or more of the subdivided lots. If the <br />prerequisites to submitting the application are not met by July 1, 2009, then the City Manager's <br />authorization to submit the application is revoked. <br /> <br />Section 2.
