<br />with the policy direction from all applicable plans. The policies generating the most discussion were <br />those pertaining to the issues of increasing the commercial land supply, whether the proposed amount of <br />commercial and residential zoned land is appropriate, and whether the property is part of an existing <br />strip commercial area, and if so, whether expansion of strip commercial is permitted. <br /> <br />The proposed zone change is being reviewed concurrently with the proposed Metro Plan and refinement <br />plan amendments. Pursuant to EC 9.7305, when the City considers a zone change concurrently with a <br />Metro Plan or refinement amendment, the City is to use the applicable procedures for the Metro Plan <br />amendment. Regarding process, the Metro Plan and refinement plan amendments and zone change <br />requests must follow the quasi-judicial procedures. New evidence will be allowed at the public hearing. <br />Since the Planning Commission’s public hearing, only one item of testimony has been received, which <br />is from the applicant and was received on February 5, 2008 (Attachment M). <br /> <br />Approval of a plan amendment requires the City to adopt an ordinance. To comply with the Charter <br />requirements for ordinances, a draft ordinance approving the requested plan amendments and zone <br />change has been prepared and is attached for your reference (Attachment A). The Planning <br />Commission’s findings of conditional approval, which provide a detailed analysis of the proposal’s <br />compliance with applicable approval criteria, are attached to the draft ordinance as Exhibit E. These are <br />identified as general findings so that the council can amend or adopt as the council determines <br />necessary. The Planning Commission’s proposed conditions of approval regarding the refinement plan <br />text amendments are incorporated into the draft ordinance. This ordinance, with any directed changes, <br />will be utilized in the event that the City Council makes positive findings that the proposed amendments <br />and zone change comply with the applicable approval criteria. <br /> <br /> <br />RELATED CITY POLICIES <br />Eugene Code requires that a Metro Plan amendment, refinement plan amendment and zone change be <br />consistent with the Metro Plan, the applicable refinement plans, as well as the Statewide Planning Goals. <br />The Metro Plan, River Road-Santa Clara Urban Facilities Plan, Eugene Commercial Lands Study, <br />Eugene-Springfield Metropolitan Area Residential Lands and Housing Study, and TransPlan policies <br />applicable to this request are addressed in the Planning Commission’s findings and recommendation <br />(Exhibit E of Attachment A). <br /> <br /> <br />COUNCIL OPTIONS <br /> <br />This is scheduled for a public hearing only. Following the public hearing, staff will assist the council in <br />determining the dates for the closing of the public record prior to council deliberations. City Council <br /> <br />deliberation and action on this item is currently scheduled for March 10, 2008. <br /> <br /> <br />CITY MANAGER’S RECOMMENDATION <br /> <br />This is scheduled for a public hearing only.
