Site Redevelopment <br /> <br />PAGE 30 OF 36 <br /> <br />8. <br /> <br />TRANSPORTATION PLANNING RULE <br /> <br />To detem1ine if the nearby transportation facilities would be affected by the zone change and plan <br />amendments, Oregon Administrative Rules (OAR) was referenced. <br />OAR 660-012-0060 - Plan and Land Use Regulation l\mendments, states: <br /> <br />(1) \\There an amendment to a functional plan, an acknmvledged comprehensive plan, or a land <br />use regulation ,>vauld signiflcantly affect an existing or planned transp01iation facility, the local <br />govenmlent shall put in place measures as provided in section (2) of this rule to assure that <br />allowed land uses are consistent with the identified function. capacity, and performance <br />standards (e.g. level of service, volume to capacity ratio. etc.) of the fkility. A plan or land use <br />regulation amendment significantly affects a transportation facility ifit would: <br /> <br />(a) Change the functional classification of an existing or planned transportation facility <br />(exclusive of correction of map enors in an adopted plan); <br /> <br />(b) Change standards implementing a functional classification system: or <br /> <br />(c) As measured at the end of the plmming period identified in the adopted transportation <br />system plan: <br /> <br />(A) Al10w land uses or levels of development that would result in types or levels <br />of travel or access that are inconsistent with the functional classification of an <br />existing or pImmed transportation facility; <br /> <br />(B) Reduce the perfbmlance of an existing or planned transportation facility <br />belo\\' the mininmIn acceptable perf(jtTuance standard identitied in the TSP or <br />comprehensive plan; or <br /> <br />(el Worsen the perf0l111anCe of an existing or planned transportation facility that <br />is otherwise projected to perfom1 belenv the minimum acceptable performance <br />standard identified in the TSP or comprehensive plan. <br /> <br />(2) Where a local govcmment determines that there would be a significant etTect, compliance <br />\vith section (1) shall be acconlDJished tlu'ouzh one or a combination of the follovving: <br />. . ~ ~ ~ <br /> <br />(<1) Adopting measures that demonstrate allowed land Llses are consistent with the planned <br />function, capacity, and performance standards of the transportation facility. <br /> <br />=;~9, ~t:1';C!r(j, F:-:winpp!"i" ,;. <br />"" ,.,.,>:' ' '... ...~.t . 1.~ Ju....,.. ..J..!.:. .'.. __11...., <br />." . -. ~ <br />nh.u.______un.hO____ u . ... <br /> <br />August28,2007 <br />
