<br />(c) New or amended community policies. <br />(d) Nel.... or amended provisions in afederallllw or regulation, state Sllltute, state <br />regulation, statewide planning goal, or state age/Icy land use plan. <br />(e) A change of circumstances in a substantial manner that was not anticipated at the <br />time the refinement plan was adopted. <br /> <br />The proposed amendments are not based on an error in the publication of the RRSC, new inventory <br />material relating to a statewide planning goal or new or amended state or federal laws, regulations, <br />or policies; therefore EC 9.8424(2)(a), (b) and (d), above, are not applicable to this request. <br /> <br />Regarding subsection (c), the proposed amendments have been found to comply with the applicable <br />Metro Plan and refinement plan approval criteria, therefore the proposed Metro Plan amendments <br />constitute a new community policy in the context of this criterion. <br /> <br />Regarding subsection (e), two significant changes of circumstance have occurred and the proposed <br />refinement plan amendment addresses both changes of circumstances. <br /> <br />First Change of Circumstances <br />The first change of circumstances is the decision by the 4J School District to sell the Santa Clara <br />Elementary School property. The City and its citizens had no anticipation at time of Refinement <br />Plan adoption that the school district would seIl its property to a private developer. <br /> <br />A pOliion of the subject site is the former location of the Santa Clara Elementary School, and is <br />currently zoned Public Land, designated on the refinement plan as Government and Education, and <br />designated on the Metro Plan. as Low Density Residential. Oregon W est Management, Inc., a <br />private development group, recently purchased the Santa Clard Elementary School site. Per <br />EC 9.2681(2) which states, "When public land is soldfor private the development, the property <br />shall be rezoned according to the procedures for zone changes beginning 'with andfiJllowing <br />section 9.8850 PumoseolZone Changes" the applicant is seeking a zone change of the subject site. <br />The refinement plan designation logically shall also be amended to reflect the current private <br />ownership. <br /> <br />The applicant has a concurrent application under review fur a plan amendment to the school <br />property to change the designation from Low Density Residential to Commercial. Upon approval of <br />the Metro Plan change the refinement plan designation will be nonconforming. As such the <br />applicant proposes to change the refinement plan designation for the school site from Government <br />and Education to Commercial to reflect the proposed Metro Plan designation. <br /> <br />Second Change of Circumstances <br />The second significant change of circumstances concerns City Council adoption in 2004 of <br />Ordinance No. 20319; which amended the Metro Plan Residential Land Use and Housing Element. <br />The background materials for the update are contained in two documents of the Eugene-Springfield <br />lvfetropolitan Area Residential Lands Study, the 1999 Supply and Technical Analysis and the 1999 <br />Site Inventory Document. The RLS was acknowledged by the state Land Conservation and <br />Development Commission as being consistent with Goal 10. The purpose of the RLS was to <br />compare residential land needs with available land supply. <br /> <br />Findings- November 19,2007 <br />Page 3 1 <br />
