<br />AGENDA ITEM SUMMARY <br />Noyember 8, 2007 <br /> <br />TO: <br /> <br />Eugene Planning Commission <br /> <br />FROM: <br /> <br />Heatl!er O'Donnell, Associate Planner, Eugene Planning Division <br /> <br />ITEl\1 TITLE: <br /> <br />Continuation of Deliberations for the Public Hearing on the Oregon West <br />Management, LLC Metro Plan Amendment, Refinement Plan Amendment and <br />Zone Change (MA 07-2, RA 07-1 and Z 07-3) <br /> <br />ACTION REQUESTED: Finish deliberations and take action on the proposed .Metro Plan amendment, <br />refinement plan amendment and zone change. <br /> <br />BRIEFING STATEMENT & BACKGROlJND: On November 5, 2007, the Eugene Planning <br />Commission began deliberations on a proposal to amend the Metro Plan land use diagram, amend the <br />applicable refinement plan and approve a concurrent zone change for Oregon West Management, LLC. <br />To sunmlarize, the applicant requests approval of Metro Plan and refinement plan amendment') and a zone <br />change that will result in 7.3 acres being rezoned to C-2/PD/SR, Community Commercial zone with <br />Planned Unit Development and Site Review overlays and 1.3 acres being rezoned to R-2/PD/SR, Medium <br />Density Residential with Planned Unit Development and Site Review overlays. <br /> <br />At deliberations, it appeared that there was some interest in recommending approval of the application, <br />rather than adopting staff's findings for denial. In anticipation of this potential outcome, staifwould like <br />to provide the Planning Commission with two potential options. If the Planning Commission confirms <br />staff recommendation for denial, the Planning Commission could adopt staff's findings. If the Planning <br />Commission recommends approval of the application, the Planning Commission \vitI need to include <br />alternative findings supporting this recommendation. Staff recommends the Planning Commission <br />incorporate the applicant's findings if the Planning Commission decides to recommend approval of the <br />application. <br /> <br />If the Plmming Commission recommends approval and adopts the applicant's findings, staff believes that <br />that there are a few criteria where the applicant's findings are either lacking or are not entirely accurate. <br />For instance, there are no findings regarding the Commercial Land Study, Policies 6,8 and 22. Therefore, <br />if adopted, the Plalilling Conmlission will need to address these areas and provide findings. Prior to the <br />continuation of deliberations, staff will provide the Planning Commission a summary of the areas where <br />staff believes that the applicant's findings would need to be amended. <br /> <br />In order to take action on November 1911\ the Planning Conmlission will need to be prepared to <br />recommend any specific modifications to staff's findings, in the event the Planning Commission is <br />prepared to SUPPOtt this application.
