<br />recorder. If the elector returns the ballot by mail, the elector must <br />provide the postage. A ballot must be received at the office of the city <br />recorder or the designated place of deposit not later than the end of the <br />period determined under subsection (2) of this section on the date of <br />the election. <br />(8) <br /> If a ballot is destroyed, lost, or not received, an elector may obtain a <br />replacement ballot. An elector seeking a replacement ballot shall sign a <br />sworn statement that the ballot was destroyed, spoiled, lost, or not <br />received, and present the statement to the city recorder before the end <br />of the period determined under subsection (2) of this section. The city <br />recorder shall keep a record of each replacement ballot provided under <br />this subsection. <br />(9) <br /> A ballot shall be counted only if: <br />(a) It is returned in the return identification envelope; <br />(b) The envelope is signed by the elector to whom the ballot is <br />issued; and <br />(c) The signature is verified as provided in subsection (10) of this <br />section. <br />(10) <br /> The city recorder shall verify the signature of each elector on the return <br />identification envelope with the signature on the elector's registration <br />card in accordance with the procedures of section 2.979(2) of this code. <br />If the city recorder determines that an elector to whom a replacement <br />ballot has been issued has voted more than once, the city recorder <br />shall not count any ballot cast by that elector. <br />(11)] <br /> Elections shall be conducted in the manner provided by state law. <br />Any ballot and any elector casting a ballot [by mail] may be challenged <br />in the [same] manner [and following the same procedure as a challenge <br />in a non-mail conducted election] provided by state law. <br /> <br />Section 16 <br />. Subsection (1) of Section 2.1990 of the Eugene Code, 1971, is <br />amended to provide: <br />2.1990 Penalties - Specific. <br />(1) <br /> Violation of section 2.988 is punishable by a fine not to exceed $500, or <br />confinement in jail not to exceed 100 days, or both fine and <br />imprisonment; in addition, the city attorney, upon request of the city <br />manager, shall institute any necessary civil proceedings to enforce the <br />provisions of section [2.988] 2.989 of this Code. <br /> <br /> <br />Section 17. <br /> The City Recorder, at the request of, or with the concurrence of the <br />City Attorney, may administratively correct any reference errors contained herein, or in <br /> <br />Ordinance – Page Page 23 of 24 <br />S0803106-attA.DOC 3/7/2008 <br /> <br />
