<br />ATTACHMENT A <br /> <br /> <br />Delta Sand and Gravel Decision Tree and Summary Findings <br /> <br />Ordinance 1 reflects the council’s direction regarding significant resources and the <br />Planning Commission’s recommendations regarding mitigation of potential conflicts. <br />Following each criteria, below, is a summary of the findings contained in Ordinance #1, <br />which is recommended for adoption. <br /> <br />Eugene Code 9.7730(3) Criteria for Approval of Metro Plan Amendment. The <br />following criteria shall be applied by the city council in approving or denying a Metro <br />Plan amendment application: <br /> <br />(a) The amendment must be consistent with the relevant <br />Statewide Planning Goals adopted by the Land <br />Conservation and Development Commission; <br /> <br />Statewide Planning Goal 1: Citizen Involvement <br /> Summary of Finding: Consistent <br /> <br />Statewide Planning Goal 2: To establish a land use planning process <br /> Summary of Finding: Consistent <br /> <br />Statewide Planning Goal 3: Agricultural Lands. <br /> Summary of Finding: Consistent <br /> <br />Statewide Planning Goal 4: Forest Lands <br /> Summary of Finding: Consistent <br /> <br /> <br />Statewide Planning Goal 5:Open Space and Natural Resources. <br /> <br />The state’s planning rules governing natural resource protections (the “Goal 5” rules) <br />provide a process in OAR 660-023for recognizing significant aggregate resources. The <br /> <br />rules define when a site is to be considered a significant resource, and lists areas of <br />potential conflict that must be reviewed when a significant aggregate resource is found to <br />exist on a site. The Goal 5 Rule evaluation criteria for an amendment to an approved <br />comprehensive plan, such as the Metro Plan, are separated into several analytical steps, as <br />presented below. <br /> <br />Step 1. Determine if the Post Acknowledgement Plan Amendment (PAPA) <br />information is adequate. <br />Summary of Findings: The application contains adequate information <br />for decision-making. <br /> <br />Step 2. Determine if the resource site is significant. <br />Summary of Findings: The applicant did not adequately prove that the <br />site contained significant resources.
