Section 2. The Eugene/Springfield Metropolitan Area General Plan is amended by the redesignation of tax lots 3600, 3601, and 3700 of map 17-04-12-00; tax lot 3600 of map 17-04- 12-20; tax lots 5600, 6200, and a portion of 100 of map 17-04-12-31; and tax lots 300, 400 and a portion of 600 of map 17-04-12-40; from “Agriculture” to “Sand and Gravel”, such territory depicted on the Eugene Springfield Metro Plan Diagram and further identified on Exhibit “A” attached and incorporated herein. Section 3. Although not a part of this Ordinance except as described above, the Findings and Conditions as set forth in Exhibit “B” attached, are adopted in support of this action. Section 4. The prior designation and zone repealed by this Ordinance shall remain in full force and effect to authorize prosecution of persons in violation thereof prior to the effective date of this Ordinance. Section 5. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof. Section 6. Identical amendments to the Metro Plan have been adopted by the Board of Commissioners of Lane County. This Ordinance shall become effective 30 days from its adoption by the City Council and approval of Mayor, as provided in the Eugene Charter of 2002.
