(6) Except as otherwise allowed by this land use code, allow disturbances <br />or development within drainage ways only when all of the following <br />conditions exist: <br />(a) The disturbance or development will not impede or reduce flows <br />within the drainage way; <br />(b) The disturbance or development will not increase erosion <br />downstream; <br />(c) The disturbance or development will not cause detrimental impacts <br />to stream side habitat values; the migration, rearing, feeding, or <br />spawning of fish; or to habit at needs of other aquatic species in <br />either the immediate stream reach or in downstream water bodies; <br />and <br />(d) The constructed pipe system is sized to convey all of the runoff <br />from upstream watershed when the upstream watershed is <br />completely developed. <br /> <br /> <br />Section 19. <br /> Subsection (3) of Section 9.6791 of the Eugene Code, 1971, is <br />amended to provide as follows: <br />9.6791 Stormwater Destination. <br /> <br />(3)Standards. <br /> Stormwater drainage facilities shall be designed and constructed <br />according to adopted plans and policies, and in accordance with standards in <br />EC Chapters 6 and 7, and the stormwater destination provisions and the <br />facility design requirements set forth in the Stormwater Management Manual. <br />On-site infiltration is the preferred stormwater destination for <br />development in the River Road-Santa Clara Basin. An applicant proposing <br />a new development must submit documentation to the city showing the <br />stormwater destination into which the proposed development will be disposed. <br />The documentation must establish that the new development will be disposed <br />of into existing stormwater drainage facilities that, considering all <br />developments that have received tentative or final plan approval as of the date <br />the developer submits a complete application, have the capacity to handle the <br />stormwater runoff that will be generated by the proposed new development for <br />the flood control design storm, or, if the applicant cannot establish that existing <br />stormwater drainage facilities have such capacity, the applicant must <br />construct storm drainage facilities to accommodate the stormwater draining <br /> <br />from the proposed development. <br /> <br /> <br />Section 20. <br /> A new Section 9.7007 is added to the Eugene Code, 1971, to <br />provide as follows: <br />9.7007 Neighborhood/Applicant Meetings. <br />(1) This section applies to the following types of land use applications: <br />(a) Type II: Only tentative subdivisions and cluster subdivisions over <br />10 lots or those which include public street improvements; <br />Ordinance - <br />13 <br />
