ADMINISTRATIVE ORDER NO. 58-16-16 <br />of the <br />Executive Director of the Public Works Department <br />TEMPORARY CLOSURE OF CHARNEL MULLIGAN PARK. <br />The Executive Director of the Public Works Department finds that: <br />A. Pursuant to the authority of Administrative Order No. 21-03-12 issued by the City <br />Manager, the Executive Director of the Public Works Department is authorized to regulate City <br />parks, protect park visitors and the park environment, and adopt rules regarding the use of parks. <br />B. Section 1.003 of the Parks and Open Space Rules, adopted by Administrative Order <br />No. 58-16-05-F, authorizes the temporary closure of all or any portion of a park, open space, or <br />facility upon finding that conditions that threaten the welfare or safety of nearby residents exist <br />and the need to preserve their welfare and safety outweighs the public's right of access to the park, <br />open space and/or facility. <br />C. The City will be undertaking a complete renovation of Charnel Mulligan Park ("the <br />Park"). Included within the footprint of the renovation project is the unimproved segment of <br />Chamelton Alley located along the western boundary of the Park. Existing improvements, such <br />as a retaining wall, are located within the unimproved alley and there is no distinguishable <br />boundary between the unimproved alley and the Park. Renovation of the Park necessitates closing <br />the entire Park (including the unimproved alley) to protect the public from construction -related <br />hazards. <br />D. A separate revocable permit has been issued to allow for Park -related renovation <br />activities to occur within the improvement segment of Chamelton Alley located at the northwest <br />corner of the park between the northern boundary of the Park and 16th Avenue. Prior to reopening <br />the Park, if necessary, this improved segment of Chamelton Alley will be permanently closed in <br />accordance with EC 5.040. <br />E. The first day that construction on the project will necessitate Park closure will be <br />July 11, 2016, with continuous closure until the project's completion, currently scheduled for <br />October 14, 2016. <br />F. The need to protect and preserve the welfare and safety of residents living nearby <br />Charnel Mulligan Park outweigh the public's right of access to the above-mentioned Charnel <br />Mulligan Park. <br />NOW, THEREFORE, IT IS HEREBY ORDERED THAT: <br />1. Beginning July 11, 2016, Charnel Mulligan Park as shown on the map attached as <br />Exhibit A to this Order shall be closed to entry by all persons other than police officers, authorized <br />City employees and persons with explicit authorization from the Public Works Director or the <br />Administrative Order - Page 1 of 2 <br />
