ATTACHMENT A ORDINANCE NO. AN ORDINANCE PROVIDING FOR WITHDRAWAL OF TERRITORIES FROM THE RIVER ROAD WATER DISTRICT AND THE RIVER ROAD PARK AND RECREATION DISTRICT, FROM THE SANTA CLARA WATER DISTRICT, AND FROM THE JUNCTION CITY WATER CONTROL DISTRICT. The City Council of the City of Eugene finds that: A. Resolution No. 4822 adopted on January 24, 2005, proposed withdrawal from the River Road Water District and River Road Parks and Recreation District, the Santa Clara Water District, and the Junction City Water Control District ("the Districts"), the parts of the Districts annexed to the City as described in that Resolution. B. The Resolution set February 28, 2005, at 7:30 P.M., Pacific Time, in the Council Chambers, City Hall, in Eugene, Oregon, as the time and place for hearing objections to the withdrawals, and directed that notice of the time and place of the hearing be published once each week for two successive weeks prior to the hearing and that the notice be posted in four public places in the City for the same period. The Notice has been so published in the Register Guard and posted in four public places in the City of Eugene, Oregon. C. The City is willing to assume the liabilities and indebtedness previously contracted by the Districts proportionate to the parts of the Districts that have been annexed to the City upon the effective date of the withdrawals. D. The withdrawals of the annexed territories from the Districts are consistent with the fundamental principles and applicable policies of the Eugene-Springfield Metropolitan Area General Plan, and other adopted City policies, and it is in the best interest of the City that the territories be withdrawn. NOW, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The territory in Lane County, Oregon, annexed to the City of Eugene on November 3, 2004, by Notice of the Lane County Local Government Boundary Commission dated December 17, 2004, as bounded and described as follows: Tax Lot 2700 and a portion of Tax Lot 5400, Assessor's Map 17- 04-14-23, located in the River Road region of north Eugene, south of Beltline Road, west of River Road, west of Bushnell Lane, north of Maxwell Road, and more particularly described on Exhibit A attached hereto and incorporated herein by reference (Dodson, EC EU 04-49) Ordinance- 1 L:\CMO\2005 Council Agcndas\M050228\S0502284-attA.DOC
