ATTACHMENT A <br /> <br /> ORDINANCE NO. <br /> <br /> AN ORDINANCE PROVIDING FOR WITHDRAWAL OF TERRITORIES <br /> FROM THE RIVER ROAD WATER DISTRICT AND THE RIVER ROAD <br /> PARK AND RECREATION DISTRICT, FROM THE SANTA CLARA <br /> WATER DISTRICT, AND FROM THE JUNCTION CITY WATER <br /> CONTROL DISTRICT. <br /> <br /> The City Council of the City of Eugene finds that: <br /> <br /> A. Resolution No. 4822 adopted on January 24, 2005, proposed withdrawal from the <br />River Road Water District and River Road Parks and Recreation District, the Santa Clara Water <br />District, and the Junction City Water Control District ("the Districts"), the parts of the Districts <br />annexed to the City as described in that Resolution. <br /> <br /> B. The Resolution set February 28, 2005, at 7:30 P.M., Pacific Time, in the Council <br />Chambers, City Hall, in Eugene, Oregon, as the time and place for hearing objections to the <br />withdrawals, and directed that notice of the time and place of the hearing be published once each <br />week for two successive weeks prior to the hearing and that the notice be posted in four public <br />places in the City for the same period. The Notice has been so published in the Register Guard <br />and posted in four public places in the City of Eugene, Oregon. <br /> <br /> C. The City is willing to assume the liabilities and indebtedness previously <br />contracted by the Districts proportionate to the parts of the Districts that have been annexed to <br />the City upon the effective date of the withdrawals. <br /> <br /> D. The withdrawals of the annexed territories from the Districts are consistent with <br />the fundamental principles and applicable policies of the Eugene-Springfield Metropolitan Area <br />General Plan, and other adopted City policies, and it is in the best interest of the City that the <br />territories be withdrawn. <br /> <br /> NOW, THEREFORE, <br /> <br /> THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> <br /> Section 1. The territory in Lane County, Oregon, annexed to the City of Eugene on <br />November 3, 2004, by Notice of the Lane County Local Government Boundary Commission <br />dated December 17, 2004, as bounded and described as follows: <br /> <br /> Tax Lot 2700 and a portion of Tax Lot 5400, Assessor's Map 17- <br /> 04-14-23, located in the River Road region of north Eugene, south <br /> of Beltline Road, west of River Road, west of Bushnell Lane, <br /> north of Maxwell Road, and more particularly described on <br /> Exhibit A attached hereto and incorporated herein by reference <br /> (Dodson, EC EU 04-49) <br /> <br />Ordinance- 1 <br />L:\CMO\2005 Council Agcndas\M050228\S0502284-attA.DOC <br /> <br /> <br />
