82 <br />ORDINANCE N0. 8642 <br />,An An Ordinance authorizing the making of a dump tender's contract, and placi <br />'all garbage and salvage at his disposal. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLL06'~fS: <br />Section 1. The Mayor and City Recorder of the City of Eugene be and they <br />fare hereby authorized .and directed to execute and deliver, on behalf of the City <br />'of Eugene, that certain garbage contract with R. R. Hughes, a copy of which is <br />Thereto attached and made a part of this ordinance. <br />Section 2. It shall be unlawful for any person, partnership or corporation <br />Ito molest, pick over or remove valuable or salable articles from garbage and tivaste <br />(material hauled or to be hauled to the city dump, such articles being the property <br />of the dump tender under a contract with the city. <br />I <br />Section 3. Any person, firm or corporation violating any of the provisions <br />!of this ordinance shall, upon conviction thereof before the City Recorder, be <br />subject to a fine of not more than X50.00 and shall pay the costs of the prosecu- <br />Ition, and in case of failure to pay the same shall be imprisoned in the city jail <br />;one day for each X2.00 of the fine unpaid. <br />Passed by the Common Council Approved by the Mayor this <br />this 13th day of May, 1940 14th day of May, 1940 <br />/s/ C. R. Hughes, party of the-second part: <br />I <br />I WITNESSET.H <br />i <br />That Whereas, the City of Eugene maintains a garbage dump on property owned <br />by the City south of the city limits, and the second party has heretofore been in <br />',charge of the same under a contract that terminates April 30, 1940, <br />Therefore, it is agreed between the parties hereto that the second party <br />Shall care for the city's garbage dump in a sanitary and worl~nanlike manner, <br />complying with all laws.and ordinances applicable thereto, for a term of two years, <br />commencing May 1, 1940, and terminating April 30, 1942, and shall receive therefor <br />from the City of Eugene X30.00 on the first day of June, 1940, and ~30.Q0 on the <br />first of each succeeding month throughout the term of this contract. <br />As an additional compensation foP the care of the garbage dump the City <br />of Eugene grants to the second party the exclusive right of salvage of all garbage <br />and tivaste material which shall be gathered in the City of Eugene, and this shall <br />constitute a property right which the second party may exercise. <br />The second party agrees to keep said garbage dump open and accessible <br />from eight o'clock in the Morning until six o'clock in the afternoon of every day <br />except Sunday, and that on Sundays the garbage dump shall be closed. <br />!
