85 <br />ORDINANCE N0. 8645 <br />i <br />An Ordinance initiating the vacation of the following described premises, <br />to-wit: <br />Indiana Street (26th Ave. E.) from the East margin <br />of Columbia Street to the ti^3est margin of Central Boulevard. <br />and calling a hearing and directing that notice be given. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS; <br />Section 1. The Common Council of the City of Eugene hereby initiates <br />vacation proceedings on its own authority without petition or consent of the <br />property owners, exe.epting as provided by statute, of the following described <br />~ property, to-wit <br />Indiana Street (26th Avenue East} from the East margin of <br />Columbia Street to the VJest margin of Central Boulevard. <br />II <br />~~ Section 2. A hearing shall be held upon the proposal to vacate the street <br />IIas herein provided, and said hearing shall be had on the 8th day of July, 1940, <br />{at the Council Chambers in the City Hall in Eugene, Oregon at 7:30 o'clock <br />'1p.m. of said day, at which time all persons will be heard upon objectiorlsor <br />suggestions with reference to the vacation of said portion of street, and at said <br />time the Council will provide for the vacation'of said premises or deny such <br />vacation, and in case tYie vacation is made will make provisions for any damages <br />sustained, by local assessment. <br />Section 3. The City Recorder be and he is hereby required to immediately <br />publish for four consecutive weeks in a newspaper published in Eugene, ~ne County, <br />Oregon, the newspaper selected by him being hereby designated as the official <br />.ewspaper of the city for this purpose, notice of the proposed vacation. Such <br />,otice shall give the description of the area to be vadated as herein set out, <br />nd state the date when this ordinance was passed; the name of any petitioners <br />etitioning for said vacation; the~date when the said petition, together with any <br />bjection or remonstrances which may be made in writing and filed with the <br />ity Recorder prior to the date of said hearing, will be heard and considered. <br />Section 4. The City Recorder shall forthwith and within five days after <br />he first publication of said notice, post or cause to be posted at or near each <br />nd of said proposed vacation, a copy of the foregoing notice which shall be <br />eaded "Notice of Street Vacation," and which notice shall be posted in at least <br />wo conspicuous places in such proposed vacation of such area. <br />The posting and the first day of publication of such notice shall be not <br />ess than twenty-eight days before the time set for hearing. <br />Section 5. Whereas, Indiana Street, which is an extension of 26th Avenue <br />ast, is an unimproved, dangerous area without any roadway or means of passage <br />hereon and serves no property and constitutes a continued menace to the city by <br />eason of possible injury occurring thereon, and it is necessary and desirable <br />nd in the interest of safety that the same be vacated; an emergency is hereby <br />eclared to exist and it is declared to be necessary for the imediate preservation <br />f the peace, health and safety of the city of Eugene that this ordinance take <br />ffect immediately upon its passage by the Common Council and its approval by the <br />ayor, and it is so ordered. <br />sed by the Common Council <br />27th day of May, 1940 <br />s/ C.
