ORDINANCE N0. 8649 An Ordinance levying assessments for the paving of Monroe Street from the South line of the Southern Pa.ciPic Railroad right of way to the North line of Seventh Avenue West in the City of Eugene, Lane County, Oregon. WHEREAS, the Common Council of the City of Eugene did by Ordinance No. 6138 passed and approved August 8, 1927, cause Monroe Street to be paved from the South line of the Southern Pacific Railroad right of way to the North line of Seventh Avenue West in the city of Eugene, Oregon, and V~FtFAS, ther~~:after the Common Council determined that the assessment ade for the cost of said improvement was levied upon property other than the roperty benefitted, and the Council has heretofore declared its intention by rdinance No. 8644 passed and approved Nlay 27, 1940, to reassess the same, and ixed a time and place for the hearing of said proposed reassessment as at the ity Hall in Eugene, Oregon, at 7:30 o'clock P.M. of June 24, 1940, and at said eating all objections raised were carefully considered and overruled, Now, Therefore THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. That the total cost of paving Monroe Street from the South ine of the Southern Pacific Railraod right of way to the North line of Seventh venue 4~est in the City of Eugene is the sum of X13,519.11 and interest thereon tom December 12, 1927, at 6 per cent per annum, and the portion thereof which as erroneously assessed against property not benefitted by said improvement is ereby by this ordinance assessed against the property hereinafter described. Section 2. That the Common Council of the City of Eugene, Oregon, has heretofore given due notice of a hearing to be held on this date, and no objections jhaving been raised to the reassessment of property abutting upon and benefitted Eby the paving of l~ionroe Street from the South line oP' the Southern Pacific Rail- road right of way to the North line of Seventh Avenue ti"Test in the city of Eugene, Oregon, as descri~:ed in Ordinance No. 8644 and in the notice of reassessment, which notice as appears by the record herein was duly advertised in the Eugene Daily News and posted in five conspicuous places in the City of Eugene for more than ten days before the date of this reassessment, does hereby determine and assess such property as follows; Name of owner at time of assessment, JAMES E. LINDLEY: Name of present owner, RICHARD SHORE SMITH, Beginning at a point in the West line of Lot 9, Block 24, Packards Addition to Eugene, Lane County, Oregon 100 feet North of the Southwest corner of said Lot 9, thence North 60 feet to the Northwest corner of said lot, thence East 133.6 feet to the Northeast corner of Lot 10, Block 24, thence South 160 feet, thence Ydest 83.6 feet, thence North 100 feet, and thence West 50 feet to the place of beginning, being all of Lot 10 and a part of Lot 9, Block 24, Packards Addition to Eugene, Lane County, Oregon.-------------X688.39 ogether with interest on the a~,ove assessment from December 12, 1927, at 6 per cent per annum. S'.ection 3. The Common Council of the City of Eugene does hereby de- clare that the property hereinbefore described is specifically benefitted to the extent of the assessment hereinbefore set forth, and does hereby declare all of said assessment to be a lien upon the respective lots, parts of lots or parcels of land against which said amount is assessed, and declares the former erroneous assessment cancelled and orders and directs the City Recorder to enter in the docket of city liens a statement thereof containing: First: A description of each lot, part of lot or acreage property liable for such improvement. Second: The name of the owner or reputed owner thereof, or that the name of the owner is unknown. 89 Third: The sum assessed upon said property and the date of entering the same in the said docket of city liens.
