<br />An Ordinance directing the City Recorder to place two charter amendments
<br />upon the general election ballot by delivering the same to the County Clerk of
<br />Dane County, Oregon for the election of November 5, 1940.
<br />~`tI~REAS, heretofore an initiative petition has been filed by the electors
<br />lof the City of .Eugene, asking the submission to the electors of a one mill levy
<br />;for two years for acquiring a site and erecting a municipal swimming pool, which
<br />;has been further submitted by the Common Council by resolution; and
<br />~ WI~EREAS, the Common Council by a resolution filed vaith the City Recorder
<br />;on the 10th day of June, 1940, resolved that there be submitted to the electors ~
<br />~~of said city for their approval or rejection at a special or general election a ~i
<br />charter amendment providing for a levy of three mills in two succeeding years, !,
<br />,three mills in each year, for the purpose of purchasing land for an airport field;.

<br />Wf~REAS, at the time of the submission of the measures it was not known
<br />whether they would be submitted at a special eleotion or be placed on the ballot
<br />~at the general election;
<br />Now, Therefore,
<br />THE CITY OR EUGENE DOES ORDAIN AS FOLLO~YS:
<br />Section 1. The City Recorder of the City of Eugene be and he is hereby
<br />(directed to prepare and deliver to the County Clerk of 3rane Gounty, Oregon, to be
<br />;placed upon the ballot at the general election to be held November 5, 1940, the
<br />;following measures:
<br />(a) "An ACT to amend the Charter of the City of Eugene by
<br />adding a new Chapter thereto, authorizing, empowering
<br />and directing the Common Council of the City of Eugene,
<br />for the purpose of purchasing land for an airport field,
<br />to include in its general tax levy for two years, such
<br />special levy as shall be required, in the judgment of
<br />the Common Council, for the purposes aforesaid, not to
<br />exceed three mills in each year, upon the dollar valu-
<br />ation, of all taxable property in the City of Eugene,
<br />commencing with the levy next succeeding the adoption
<br />of this Act, and for the levy in the next succeeding year,
<br />said levy to be in addition to and in excess of th e
<br />constitutional six percent limitation upon the city's
<br />tax levy."
<br />(b) "AN ACT to amend the Charter of the City of Eugene by
<br />~~ adding a new chapter thereto, authorizing, empowering
<br />and directing the Common Council of the City of Eugene
<br />for the purpose of acquiring a site and erecting a muni-
<br />cipal swimming pool, to include in its general tax levy
<br />each year for two years, to-wit: for the Levy made in the
<br />fall of `1940 and for the levy made in the fall of 1941,
<br />such special levy as shall be required in the judgment,
<br />of the Common Council for the purpose aforesaid; not to
<br />exceed in each year one mill upon the dollar valuation
<br />of all taxable property in the City of Eugene,. said levy
<br />to be in addition to and in excess of the constitutional
<br />six per cent limitation upon the city's tax levy."

<br />,' Section 2. The City Recorder be and he is hereby further directed to
<br />jpublish notice of said measures, together with the notice for the general city
<br />election in some newspaper of general circulation in the City of Eugene for ten
<br />,days prior to the date of the election.
<br />Section 3. The City Recorder be and he is hereby directed to prepare
<br />the pamphlet provided for by the Initiative and Referendum Law for distribution
<br />to the electors of the City of Eugene covering the above two measures 'and to cause
<br />the same to be completely distributed at least eight days before the date of the
<br />election, to-wit, November 5, 1940, and do any and all things necessary and con-
<br />venient for the orderly placing of the measures before the people at said election.
<br />Section 4. The Common Council f
<br />be, together vaith the regular city ballot,
<br />election of l~ovember 5, 1940 and be placed
<br />Clerk of Lane County, Oregon.
