129 <br />OxD1NANCE NO. 8681 <br />An Ordinance vacating the following described area, to-wit: <br />All of that portion of the alley in Block 2 of Ramble <br />Addition to Eugene lying east and south of the extension <br />of the north line of Lot 10, Block 2 across the alley, <br />all in Lane County, Oregon. <br />WHEREAS, heretofore and on the 26th day of 1VIay, 1941, the Common <br />Council of the City of Eugene passed an Ordinance setting a hearing for the 14th <br />day of July, 1941 in the Council Chambers, at which time and place protests and <br />remonstrances could be heard as to the vacation of the following premises, to-wit: <br />All of that portion of the alley in Block 2 of Ramble <br />Addition to. Eugene lying east and south of the extension <br />of the north line of Lot 10, Block 2, across the alley, <br />all in Lane County, Oregon. <br />and, <br />WHEREAS, a hearing was held pursuant to said Ordinance in the <br />Council Chambers in the City Hall in the City of Eugene on Monday, the 14th day <br />of July, 1941 at 7:30 o'clock P. M, and at said time the Council heard all <br />objections, and <br />WHEREAS, all persons owning property abutting upon said alley proposed <br />to be vacated have consented to said vacation and have applied for said vacation, <br />and the City Planning Commission has consented to said vacation, it being the <br />purpose of said vacation, that the portion of alley is on a hillside in a draw <br />where it is most difficult to improve and is a blind alley having no outlet and <br />is~so used as to be dangerous for use and liable to involve the city in damage <br />claims. <br />Now, therefore, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOVIS: <br />Section 1. The 'Common Council of the City of Eugene finds that due ~ <br />and legal notice of said hearing was published as posted as required by law; that ~ <br />no valid objections has been made at said hearing, or filed; that the consent of <br />the owners of the abutting property and the consent of the City Planning Commissio <br />properly acknowledged, has been filed in said proceeding; and that the public <br />interest will not be prejudiced bar the vacation of said portion of alley. ~ <br />Section 2. That said hearing was held on the 14th day of July 1941, <br />at 7:30 o'clock P. M. in the Council Chambers of the~City Hall in Eugene, ~ane <br />County, Oregon, and that all matters necessary to be done have been completed. <br />Section 3. That the following described area, to-wit: <br />All of that portion of the alley in Block 2 of Ramble <br />Addition to Eugene lying east and south of the extension <br />of the north line of Lot 10, Block 2 across the alley, <br />all in Lane County, Oregon. <br />be and the same is hereby vacated and the area so vacated, being a portion of an <br />alley, shall revert to the abutting property pursuant to the statutes of the <br />State of Oregon, reserving however, to the City of Eugene the perpetual right <br />to maintain any public utilities or structures now in the alley and to lay down <br />at any time that the Council deems necessary or convenient any public utility in <br />the alley, and reserving the right to enter upon the alley and maintain the same. <br />Section 4. The Recorder be and he is hereby directed to file a <br />certified copy of this ordinance with the Recorder of Lane County, Oregon, <br />together with a map or plat of said property, and that a certified copy of the <br />ordinance shall be filed with the County Assessor and another certified copy of <br />the ordinance shall be filed with the County Surveyor. <br />Passed by the Common Council <br />this 14th dUy of July, 1941. <br />App ~ved by the Mayor this <br />a~ - day of July, 1941. <br />/s / JOHN FIELDS <br />ity Recorder pro-tem <br />/s/ ELISHA LARGE <br />Mayor <br />
