140 <br /> <br />ORDINANCE N0. 8690 . <br />An Ordinance amending Section Thirteen of the Ordinance Number 8413 entitled, <br />"An Ordinance to create or divide the City into Districts within <br />some of which it shall be lawful, and within others of which it <br />shall be unlawful to erect, construct, alter or maintain certain <br />buildings, or to carry on certain trades or callings, or within <br />which the height and bulk of future buildings shall be limited, <br />and providing For setback lines, and providing fora penalty for <br />the violation thereof." <br />passed by the CiO~omon Council April 8, 1935 and approved by the Mayor April 9, 1935, by extending <br />the provision as to setback lines. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLL(~S: <br />Section 1. That Section 13 of Ordinance No. 8413 entitled, <br />"An Ordinance to oreate or divide the City into Districts within <br />some of which it shall be lawful, and within others of which it <br />shall be unlawful to erect, construct, alter or maintain oertain <br />buildings, or to carry. on certain trades or callings, or within <br />which the height and bulk of future buildings shall be limited, <br />and providing for setback lines, and providing for a penalty for <br />the voilation thereof." _ <br />passed by the Common Council April 8, 1935 and approved by the Mayor April 9, 1935s be and <br />the same is hereby amended to read so as to add tha following; <br />"Setback lines are hereby established upon East Broadway from <br />High Street to its,3unction with the Southern Pacific railway <br />track of 16 feet on each side of Broadway, and no building or <br />structure shall be erected nearer to said street than as herein <br />provided, except that the Common Council may upon applicati on of <br />a property owner by special ordinance change or alter or condition <br />the setback line as to a particular property." <br />The City Engineer be and he is hereby authorized and directed to place the <br />foregoing setback lines upon the Use Map of the City of Eugene and immediately draft such <br />line upon the Use District Bdap and the said lines be and they are hereby established as the <br />setback lines between said terminals of High Street to its ~unotion with the Southern Pacific <br />railway track in tre City of Eugene. <br />Section 2. VYFiEREAS, Buildings are being erected which are not in conformity <br />with structures already around the streets, thus greatly inuring the general appearance of <br />the city cad the property rights oP persons who have already built, therefore en emergenoy is <br />declared to exist and it is necessary for the immediate preservation of the pease, health and <br />safety of the .city that Chia ordinance take effect immediately upon its passage by the Common <br />Council and approval by the Mayor and it is so ordered. <br />Passed by the Common Council <br />this 25th day of August, 1941. <br />_~3~ JOHN FIELDS <br />City Recorder pro tem <br />Approved by the Bdayor this <br />26th day of August, 194].. <br />~S~ Elisha Large <br />Mayor <br />
