1a5 <br />I~/IPROVEII~NT ORDINANCE <br />N0. 8'712 <br />An Ordinance for the construction of a sanitary sewer on the East side of <br />4`Jashington Street from Twenty-second Avenue to Twenty-third Avenue, tb-wit: <br />Commencing on the North side of TwentyY=second Avenue at the alley between <br />ti`Jashington street and Jefferson street, running thence South across Twenty- <br />second Avenue, thence East to the East side of ~yashington Street, thence South <br />on the East side of 4~+ashingtori street to Twenty-third Avenue, in the City of <br />Eugene, Oregon, and declaring an emergency; <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOti"1S: <br />Section 1. The Conunon Council of the City of Eugene does hereby declare <br />its intention to build and construct a sanitary seVaer on the East side of <br />Washington street from Twenty-~ec.orid Avenue to Twenty-third Avenue, to-vvit: <br />Commencing on the north side of Twenty-second Avenue at the alley betvaeen Vdash- <br />ington street and Jeff_'er•son street, running thence South across Tvaenty-second <br />Avenue, thence East to the East side of Washington street, thence South on the <br />East side of ~~ashington street to Ttiventy-third Avenue, in the City of Eugene, <br />Oregon. <br />Section 2. The said sewer shall be constructed of first class cement or <br />vitrified pipe, according to the plans and specifications of the amity Engineer. <br />Section 3. The City Engineer is hereby directed to survey out the location <br />of said sewer, and prepare plans and specificiations and a profile thereof, and <br />file the same wi tYi the City Recorder. <br />Section 4. the construction of said sec:~er• shall{include all necessary <br />manholes, ~°ryes, and all things necessary and convenient for tiie complete building <br />thereof . <br />Section 5. The whole cast of the construction of said sewer shall be borne <br />by and shall be assessed to the lots, parts of lots and acreage property liable <br />therefs~r, and benefitted by the construction thereof in proportion to the benefits <br />accruing to each lot, part of lot, or acreage property as shall be ascertained <br />and determined by the Council. <br />Section 6. Upon the completion of the sewer, the Common Council sriall <br />ascertain the cost thereof and assess that portion thereof against the lots, parts <br />of lots or acreage property liable therefor or benefitted thereby in accordance <br />with the provisions of the Charter of the City of Euge~~e, and when said costs <br />are so assessed the same shall be entered in the City Lien Docket, and be <br />furtYier enforced as provided by the City Charter. <br />Section 7. Whereas, the improvement contemplated and provided for by this <br />ordinance, is a necessary improverr~ent and the district of the city in which said <br />sewer is to be constructed is in such a condition that the construction of said <br /> <br />sewer is essential to the health and safety of the residents of said district, it <br />
